Well first of all, there is nothing in our employment agreement that says you can't fuck your coworker.
Second, it's really not my boss's business what we do in our free time.

Of course, I am sure she would frown upon it if she found out, but it's not like she could fire either of us for it. It's not like we are fucking at work, or letting it otherwise effect the quality of work we do. (although calling me from the work cell phone that my boss pays for is pretty borderline)

Either way, even if she suspects something was up, there is no way she could prove it. Nor should she have reason to unless our work begins to suffer.

you can as long as you were not let go with cause. (i.e. you didn't come into work a lot, you cussed out your boss, etc etc). If you are just let go "because" and there is no real reason behind it, they have to pay your unemployment. same thing as getting laid off.

^^ but a lot of it also depends on if the company wants to fight the ESC claim. At my last job, we had a girl get fired for poor sales numbers. In fact, she didn't sell shit for about 6 months. When she filed for unemployment, the company could have easily fought the claim and they probably would have won. But they didn't even fight it, and she is still on unemployment today last I heard.

On the contrary, my roommate got fired from the bar he worked at for "allegedly" putting something in another coworker's drink. He tried to claim unemployment, the bar fought the claim stating the reason why he was fired, and the ESC denied his claim.

Being a staffing agency, my boss fights EVERY unemployment claim.
