do they even need to go through nsa? i can log on to verizon at any time and see incoming/outcoming calls, dates, duration, etc. not sure how far back those records go, maybe like 2 years? i suppose nsa probably has records going back even further.

This case makes me sick, because the Cary DAs did everything they could possibly do to prevent discovery of exculpatory evidence, including not giving the defense access to evidence needed to subpoena 3rd parties until after those 3rd parties' privacy policies would warrant destruction of the evidence the defense would need. And since the defense can't prove that such was the purpose of the delays, the prosecution gets away with it.

I don't have any hate for the prosecutors. They weren't very good, but they were just doing their job. The judge is the one that fucked the dog and the jury helped him.

I have a lot of hate for the prosecution. They weren't just "doing their job." They conspired with the attorney in the custody hearing to deny Brad his 5th Amendment rights, and then intentionally introduced shit from that deposition completely out of context to make Brad look bad. They conspired with police to destroy evidence on TWO cell phones. They used the fucking FBI to analyze a computer when the SBI could have done the same, so that they could hide behind "national security", in an otherwise fucking inconsequential murder trial, mind you, when the defense wanted to question the analysis. They lied about and misrepresented every single piece of evidence in the trial, and then, by delaying the trial with non-stop gossip for two straight weeks, turned the jury against the defendant by making the jury sick and tired of the whole damned charade. And why did they do all that? Because they wanted to win. No one in the DA's office cared about fucking justice. They just wanted to win, and they don't care who they hurt in the process. Fuck them. Fuck them hard.

^this... And even worse in gessner for not fixing those missteps. Its probably for the best, though, a mistrial would be tried in his court. At least now he'll get a new judge.

The state's only concrete evidence in the case was a Google Maps search of the site where her body was found.

Prosecutors contended it was made the day before Nancy Cooper disappeared, but defense attorneys argued that someone tampered with Brad Cooper's computer while Cary police searched the couple's house for evidence.

Two defense witnesses weren't allowed to give their expert opinion that someone tampered with the Google Maps files, and the appeals court said the trial judge should have allowed the testimony.

"The Google Map files recovered from the defendant's laptop were perhaps the most important pieces of evidence admitted in this trial," the three-judge Court of Appeals panel wrote in its ruling."

I won't claim that he's definitely innocent, but he was convicted on some extremely shaky evidence. there was plenty of reasonable doubt.
