hahaha speedy is so subjective it seems.

anyway here...i don't really know the specifics about what would happen to people if there was a moratorium and then nc overturned the dp (that isn't really likely to happen though). as i understand it, a moratorium doesn't prevent people from being sentenced to death. but you can go to the NCGA website and read up on the bills or here is the moratorium website but obvi that is a little bias http://www.ncmoratorium.org/site/default.asp

yeah, i've noticed that. but ive also noticed that they do waste time between the conviction and sentencing phases. whats up with that? its like... "you're guilty, come back in 6 months to find out if you're going to prison"

hahaha it seems like they do it just to fuck with you. in NC they do it immediately, or like the next day or whatever.

mainly because of the parole officer people being a huge part of the sentencing process. they do very long and detailed reports in an essay style for every person before they are sentenced. unlike the state system, in the federal the parole officer's opinion really matters. the pleading guilty part doesn't take that long but writing papers on every single person to advise of everything about a persons life before they're sentenced does. and while they're doing that, they're also doing the normal checks on ppl/drug tests/etc that the state level PO's do.

NC does not have parole anymore because of structured sentencing. The only parole now is for people sentenced before this went onto effect.

misdemeanor B&E and larceny aren't murder. i'd like to point that out again. neither is owning a gun. even if youre a convicted felon.

thats really not a bad rap sheet at all. no history of violence at all, from whats shown there

also its weird that that misdemeanor b&e is a class H felony. it must be some law about multiple misdemeanors of b&e raising it to a low felony

nc database does tell shit. it shows all the CONVICTIONS that resulted in either probation or prison. in other words, if its not on there, its not worth mentioning.

right here is the previous felony. either theres some rule about repeat B&E offenders that makes it a felony to keep doing it

OR its possible that there are other charges with that case number and one is a felony. but.... i think they always list the worst crime as the principal.

for example, my latest entry in the doc site was for 4 misdemeanors (3 counts of the same one, and one count of another), it only shows the worst one, but i plead guilty to 4 and was punished for them concurrently

i guess theres some rule that makes it worse if youre a repeat offender. like 3 strikes on a misdemeanor gets charged as a felony or something. never seen a specific law though

if either of them go to trial will it be held in chapel hill? or even in nc? since it was so public and everyone would know and more in likely have an opinion on the mater?

how many people do you think in chapel hill or the triangle don't have an opinion on it? not that i want it to be any easier for murders but isn't it apart of a fair trial for a case to be moved if its something that has been played out in the media or widely known about?

i wonder if they'll continue to investigate now that they've made arrests. and i wonder how much evidence they have. seems like they'd talk more if they had anything now that they have their guys.

i also wonder what probable cause they had. cause i guess an ATM card and all that would be probable cause, but its nowhere near enough to convict.

maybe they're just banking on a redneck jury.

We know you're trying to antagonize all the people who want to lynch these two young men before a trial, but it is reasonable to assume they have more information on the case than they have made public. I highly doubt the case is going to be "check out these two surveillance pictures. Yep, thats the two guys who killed her."
