I think I would believe her more if she saw him on the news, and then contacted police. Rather than police going from gas station to gas station to see if anyone had seen him, showing her the picture, and then she says it must be him, months later.

Did they address the height discrepancy at all?

Watching the afternoon portion, will go back and watch the morning session to see what the defense asked.

the afternoon has been quite dull, asked the lead investigator questions, most which had no real link to the case or any big AH HA! moments IMO.

Jason Young, 37, was arrested in December 2009 in connection with his pregnant wife's beating death. He is on trial for a second time after a jury failed to reach a unanimous verdict in his first trial last summer.

Michelle Young was found facedown in front of Jason Young's closet in the master bedroom on Nov. 3, 2006.

Testifying Monday Michael Galloway, an investigations supervisor with the City-County Bureau of Investigation, said that there were bloody footprints and shoeprints all over the upstairs floor and that it appeared to him that someone had moved Michelle Young's body to get into Jason Young's closet, which likely had been closed during the attack.


He said Tuesday that he tested numerous items, including the drains of the sinks in the house and Jason Young's white Ford Explorer, and found no evidence of any blood with the exception of a drop on the knob of a door leading from the Youngs' house to their garage.

Defense attorneys say their client was out of town on business, that there is no physical evidence linking him to the crime and that the case has not been solved.

Prosecutors, however, contend that Jason Young's marriage was in trouble and that he did not want to be married anymore.

They allege that he traveled to Hillsville, Va., about three hours from Raleigh, checked into a Hampton Inn hotel and then returned to Raleigh to commit the crime.

Hotel employees have testified to finding an emergency door propped open with a landscaping rock and a security camera in the same hallway unplugged and later pointing toward the ceiling during the time that the state says Jason Young would not have been at the hotel.

In addition, a hotel maintenance employee testified last week that Jason Young's electronic room key had been used only once after he checked in, even though security cameras captured him outside his room an hour later.

Galloway testified that he visited the hotel on Nov. 4, 2006, and found no forensic evidence there either. It was unlikely though, he said, since the room had been cleaned after Young checked out.

He returned to the hotel two other times, including once after Jason Young's first trial, to test investigators' theories as to how Jason Young might have gotten back into his room and the building without using his key.

Galloway said he tested the emergency door with a landscaping rock and also a twig from a nearby bush and found that both could have kept the door open. Jason Young testified during his previous trial that he went out the door to smoke a cigar and used a twig to keep it open.

Galloway said he also found that the hotel room door could have been propped open several different ways using the inside locks on the door as well as the "Do Not Disturb" sign on the knob.

He was also present on Nov. 7, 2006, when investigators had Jason Young strip naked and photographed him for any injuries that might have occurred during the course of his wife's beating death.

With the exception of a bruise in the nail of the big toe of Jason Young's left foot, Galloway said, he didn't observe any other bruises, scratches or cuts on Young's body."

the answer is NO. the shoes were too small to be that of JY.

as for the cameras, there was fresh DNA and prints on the camera that DID NOT match JY.

the tire track and 911 call are new evidence I expect them to bring about later...but we will see.

In the first trial they did have testimony that one of the set of the bloody shoe prints exactly matched a pair of hush puppies (exact size and sole) that he was known to have owned that year.

it was too small and they never found those shoes if I remember correctly.

No, they were size 12. His size. The FBI even had the factory in China make a pair in his exact size to compare to the prints they took, and it was a perfect match. There were other footprints from a different shoe that were size 10. Two different pairs of shoe prints in the blood. So, two people were there, or one person tromped around in two different pairs of shoes.

True, they never found the shoes (or ANY of the clothes he was wearing on surveillance in the hotel video for that matter.) They only found the shoe store records proving that he owned the exact shoes that matched the footprints prior to the murder. But, he bought a brand new pair just about exactly like them within a week of his wife's murder.

Please note that these were not a super common type of shoe. The footprint experts had never encountered them before (including the FBI guy at Langley who looks at foot prints and databases of footprints all day for 30 years.)

how is it even relevant that nobody has ever before worn this exact type of shoe while committing a murder that leaves shoe print evidence?

What gets me is that both of them knew his wife, and one of them was very good friends with her.

none of the prints were sized by the latent shoe print expert.

You still have yet to show me ANY evidence that the sizes matched. It never happened.

JT, still dont understand exactly what you mean, but unless I am mistaken an agent testified this late this afternoon to sizing a shoe impression that was found on what appeared to be some sort of bedding taken from the scene. Might be states evidence 75? The sizing was redundant as "10" was clearly visible once the impression was enhanced, but he did it anyway to be sure. Ill have to go back and rewatch that portion of the testimony to be sure but it appeared to be a RH shoe impression. I have to admit I am curious if any of the size 12 hushpuppie shoe impressions found were from RH shoes, and if any LH impressions from the Franklin shoe were found, but I suppose if you are going to track through your bloody scene once in shoes you intend to dispose of, then why not change shoes and do it once more instead of wearing a 12 on one foot and a 10 on the other.

Thats what im trying to say...I dont remember them ever saying it was a size 12 hushpuppy. Those shoe impressions never got sized. The 10 maybe because of the molded portion of the shoe, the hushpuppies were never sized.
