From what I remember, the stripper came from an escort service. They could have simply called the escort service and asked for a stripper, and have no idea what race she would have been.

Then she shows up, the lacrosse team sees that she's black, they get pissed, and haterape her as a result.

to further push the race issue, a 911 call has been printed describing more verbal abuse towards a black girl

Quote :
"Emergency 911 tapes revealed that on the night of the alleged incident March 13, a black woman tearfully reported that a man came out of 610 N. Buchanan Blvd. as she and a friend passed by and shouted a racial slur at them. WARNING: The following transcript of the call contains offensive language.

12:53 A.M.

TELECOMMUNICATOR: Durham 911, where's your emergency?

CALLER: Hi, I don't know if this is an emergency or not, necessarily, but I'm in Durham, and I was driving down near Duke's campus, and it's me and my black girlfriend, and the guy -- there's like a white guy by the Duke wall -- and he just hollered out "nigger," to me. And I'm just so angry I didn't know who to call. (Crying).

I don't know if this is an emergency. They're just hanging out by the wall on Buchanan [Boulevard].

TELECOMMUNICATOR: On which side?

CALLER: It's right outside of 610 Buchanan [Blvd]. And I saw them all come out of, like, a big frat house, and me and my black girlfriend are walking by, and they called us "niggers." (Sobbing).

So I don't know what's gonna happen. I'm not gonna press the issue, I guess. But I live in a neighborhood where they wrote KKK on the side of a white station wagon, and that's near right where I'm at, you know what I mean. And they didn't harm me in any way, but I just feel so completely offended, I can't even believe it.

I thought, you know what I'm saying, times have changed, and I don't even know what's going on.

It's right in front of 610 Buchanan. I saw them coming out of this frat house. 610 North Buchanan. ...

So, I'm not going to press the issue, but, whatever, however Durham city feels about racial slurs and stuff, however you guys want to handle it, you can handle it however you do. I'm not hurt in any way, OK."

I don't think they said that he specifically wasn't there, but that he was ruled out by the victim, so did not have to provide a DNA sample.

And going further with that, since she was able to make some sort of a visual identification, you'd think they'd also do a line-up to see if she recognized her attackers. Of course, maybe they did, but it wasn't reported by the news.

^ right. He just didn't have to submit DNA because the victim identified her attackers as white men. Thus, the other 46 out of the 47 player son the lacrosse team had to give samples.

Here's the search warrant. Look at page 4 and it details the accusers statement to police. It also lists the first names of the guys who rented the place.

a nice timeline from ny times

http://www.nytimes.com/2006/03/30/sports/30timeline.html?_r=1&oref=slogin

Quote :
"SATURDAY, MARCH 11 The Duke lacrosse team, ranked third in the nation, defeated No. 20 Loyola, 9-7, in San Diego, improving its record to 5-1. Coach Mike Pressler said, "Now we look ahead to one of the most difficult weeks in Duke lacrosse history, with North Carolina next Saturday followed by a Tuesday game with Cornell and then Georgetown the following Saturday."

TUESDAY, MARCH 14 At 12:53 a.m., a woman called 911 to report that a man had shouted racial slurs at her and a friend as they walked by a house owned by Duke and rented by several players.

At 1:22 a.m., a security guard at a Kroger grocery called 911 to report that a woman outside the store had refused to get out of her car and that she appeared intoxicated. After the police arrived, she accused three lacrosse players, whom she identified by first names, of forcing her into a bathroom at the house and sexually assaulting her for 30 minutes. The woman said she and another woman had been hired to perform as exotic dancers for a party at the house.

WEDNESDAY, MARCH 15 Duke begins looking into the incident less than 24 hours after it was reported, the university's president, Richard H. Brodhead, later said.

THURSDAY, MARCH 16: In an affidavit for a search warrant, Durham police investigator Benjamin W. Himan described the woman's account of rape, assault, kidnapping, robbery, strangulation and hate crimes. A magistrate approved the search warrant seeking DNA evidence, clothes, cameras, computers and other evidence in and around the house. After the search, three residents of the house, all lacrosse captains, were interviewed by the police and agreed to go to Duke University Medical Center to provide DNA samples.

SATURDAY, MARCH 18 Duke defeated North Carolina, 11-8, at home.

TUESDAY, MARCH 21 Duke lost to third-ranked Cornell, 11-7, at home.

WEDNESDAY, MARCH 22 A lawyer for some of the players canceled a planned meeting between players and investigators. The district attorney obtained a court order to compel DNA samples. The police reveal that in their search of the house, they seized four laptop computers, five cameras, a bath mat, a bath rug, five broken artificial fingernails, a bottle of K-Y jelly and cash.

THURSDAY, MARCH 23 Forty-six members of the team reported to the Durham police crime lab to provide DNA samples and be photographed. Some were also interviewed.

FRIDAY, MARCH 24 The players attended practice after a two-day break that the coach attributed to the emotional loss to Cornell. "All our focus is on trying to beat the Hoyas now," Pressler said of the Georgetown game.

SATURDAY, MARCH 25: As community members organized a protest at the lacrosse stadium, Athletic Director Joe Alleva announced the team would forfeit the game against Georgetown and a game Tuesday against Mount St. Mary's for violating policy with the party and underage drinking. Alleva said the team's roster would be removed from the university Web site.

SUNDAY, MARCH 26 About 100 protesters banged pots and pans outside the house and about 60 marched to the home of the university's provost to call for more action to protect the community.

MONDAY, MARCH 27 The police searched a second home where lacrosse players live.

TUESDAY, MARCH 28 Brodhead met with the captains of the team and he said they denied having sex with the dancer. Brodhead announced the suspension of the season until the case was resolved. The captains issued a statement saying that DNA results would "demonstrate that these allegations are absolutely false." Michael B. Nifong, the Durham County district attorney, said in a television interview, "I am convinced that there was a rape."

WEDNESDAY, MARCH 29 Protesters taking part in a rally against sexual violence handed out fliers asking anyone with information about the incident to call the police. The lacrosse team resumed practice."

You think if these guys were smart enough to go to Duke they'd figure out how to get rid of some evidence, like take out the trash or do some laundry.

from News & Observer:

Quote :
""The fact that the DA is out in public saying these boys are guilty is just extraordinary," said Joseph B. Cheshire V, a prominent Raleigh lawyer who represents team captain Dave Evans."

These students and their parents are loaded. When you have a lawyer who uses his middle initial and was named after his great-great-grandfather, that's serious money there.

On a side note, you can tell a defense argument will be to move the trial cause if it's a local trial, the jury will be biased against them (which calls for another ).

that's such crap

#1 he was probably drunk when he wrote it
#2 people write stupid stuff like that all the time (see: Chit Chat)

I find it impossible to believe any of that was actually meant...this is "taking something out of context" in its truest

you're saying that you've never said "you'd kill somebody" or something retarded when you were drunk?

who knows if this guy didn't love Silence of the Lambs and the "skinning" thing was an inside joke between him & someone else. Realistically, this was NOT meant literally.

Its obvious that there was a scuffle when the strippers came over. Everybody was drunk, including the strippers. My theory is that there was a disagreement over money and a fight broke out. I'm sure the guys were pissed about the stupid stripper causing trouble and not getting naked.

So this kid's idea of a joke is that they cut to the chase and just kill the strippers next time, rather than deal with that bullshit again.

Quote :

Its obvious that he is referring to a show gone bad. The only question is whether there was any rapage involved. I have my doubts, and the DNA evidence (or lack thereof) will show who is lying.

^^ that sounds probable especially since the strippers claimed they only expected 5 people and it ended up being 30. However, that isn't enough to invalidate the physical signs of rape discovered from the woman and the amount of time she was discover from when she supposedly left the house.

People can and will hurt themselves to claim rape and get money. I'm not saying that's DEFINITELY the case, but it was the perfect setup to win a lawsuit.

I know, but that is why i brought up the amount of time she was discovered, pointing out the 911 call from the store worker who saw her. It would seem like she would have had to do alot in a little bit of time to make up the rape.

^^^Yeah the "physical evidence consistent with rape" is a pretty damning piece of evidence. I wonder how they physically distinguish between the consensual pounding she takes being a whore and the signs of forced entry. External scratches and bruises could easily be explained by the fight I suspect took place.

I can't believe any of you would defend these people. Yes we don't know what actually went on but if someone had verbally said that I can imagine it would have been taken very seriously by someone hearing it. Taken out of context or not it was inappropriate and it just so happens that it happened minutes after this aleged rape. He deserves to be suspended.

honestly... ya the wording is bad. but really half this board has threatend to fight/kill/maim/ someone else at one point. Being massively drunk and angry because you think you got ripped off really doesn't help.

if you just raped someone, who's obviously going to go to the cops, do you really write an email saying you're going to cut her skin ?

I dont really know what to believe. I can definitly see the alliegations being true

but i can also see the two strippers coming to a house full of guys who were sloshed... and deciding .... hey this shit isnt a good environment fuck this I'm going to head out.

if you think he deserved to be suspended from school for making a poor joke and dropping the n-bomb .... I dont know what to tell you ;x at most he deserved forced classes on social relationships and expected behavior... but honestly he deserved a talking to and dirty looks for being a douchebag. you dont get suspended from school for being a douchebag.

I dont think so far there's enough information to make a decision either way. I'll say it definitly doesn't help their case that everyone and their mother screams rape at athletes and it'd seems a good deal of them are lying.

just too early to tell.

One thing to remember is that supposedly three out of 30 men raped this woman, so this one guy who wrote the email didn't necessarily have to be one of the three. Nor does it mean he could have had knowledge that any activity occured with the woman and the other 29 guys other than the expecting stripping and dancing.

^^ I am sure it makes him a primary suspect now but unless he wrote in the email some evidence pointing him out, the dna evidence points to him, or the woman who has been allegedly raped is now identifying him as one of the three; I don't think you can say with certainty that he was one of the three.

That's rediculous. I, and about 500 others, have said much more brutal/stupid/crude/racist remarks in Chit Chat, Facebook Walls, and probably emails.

The timing was terrible, but in no means should that email ALONE (assuming he's proven innocent) warrant a suspension.

Bottom line: Duke's acting all drastic so the boosters will keep sending money. You could talk to a 50-year old Duke alum 'til you're blue in the face (hah) and they'd never understand it was taken out of context.

If Duke didn't suspend him, the court of public opinion would definitely get him whether it is through people against rape and violence or other groups. The school would then be attacked for not doing so. I am pretty sure he is going to have if life threatened after this as well. Duke supposedly suspended him as means of protecting him since they didn't have any other ground for suspension. Justified or not the wave of backlash would and will anyway come.

thought this was a good read
http://www.insidelacrosse.com/page.cfm?pagerid=2&news=fdetail&storyid=118934

they did a good part summarizing the questions:
Quote :
"In the first 911 call the woman initially claimed: “I'm in Durham, and I was driving down near Duke's campus…” But just seconds later on the same phone call, stated: “and me and my black girlfriend are walking by.”

The lawyers also pointed out the discrepancy in the phone call of the number of men allegedly harassing the two women. At first, the caller claims, “and the guy, there’s like a white guy by the Duke wall, and he just hollered out ‘n-----’ to me,” but later in the same call adjusts the story, claiming multiple men approached them. “And I saw them all come out of, like, a big frat house…and they called us ‘n------.’”

"That's all part and parcel with where we're going with this whole case," Williams told the Herald-Sun, "that a lot of these allegations that have been made never happened."

Williams also was skeptical about the number of times the caller repeated the address of the house, claiming someone who was just passing by, either driving or walking, would not easily be able to identify the address.

"I've been out there," he said. "And [the house number] doesn't show from the street."

The Herald-Sun article says a reporter investigated Williams’ claim about the visibility of the address, confirming that the address was not visible from “the street, the sidewalk or the front and side lawns of the house.”

Williams told the Herald-Sun he believes the woman who made the initial 911 call was more involved with the situation than she told the dispatcher on the phone call.

"That lets you know it was somebody who — she's part of the situation," he said.

Another defense attorney who is not representing any of the players echoed Williams’ skepticism to the Herald-Sun.

"It all sounds a little too pat for me," said defense attorney Tom Eagen. "If you can't even see the number from the street, How did they know? How were they driving and walking and who the hell was the girlfriend?"

More discrepancies in the initial stories began to unfold as well, including who drove the alleged victim to the Kroger grocery store.

In an article filed by the Herald-Sun on March 29, Angel Altmon, the security guard who made a 911 call at 1:22 a.m. on March 14, is quoted extensively. Altmon claimed the driver of the car said she was not at the party with the alleged victim. The driver, who identified herself as “Kim”, told Altmon she was driving near the party scene, saw the victim walking outside with “a whole lot of Duke guys hollering at her” and picked her up.

But in an article in the Duke Chronicle the following day, Kammie Michael, public information officer for the Durham Police Department, told the Chronicle the woman who drove the alleged victim to the grocery store was in fact the second dancer at the party.

"

Quote :
"When Abrams asked whether Williams was suggesting that the women involved in making the 911 calls and the dancers were in cahoots in a scheme to make false charges, Williams responded by saying, “Ah, now you are starting to see where I am going.”"

Quote :
"Also, Friday’s Herald-Sun reports that official police logs note that the first 911 call was received at 12:53 a.m. on March 14. An officer was immediately dispatched to 610 N. Buchanan and arrived at 12:55 a.m. Police reportedly stayed at the scene until 1:06 and the second 911 call was made 16 minutes later, at 1:22 a.m.

But, a police spokesperson had said that, despite arriving just two minutes after the initial 911 call, the police found no complainant at the scene and that the house looked like no one was home. Police left after checking the scene for several minutes.

In addition, the victim was driven to a Kroger store 2.3 miles away from the alleged scene of the crime. At least one lawyer questioned why the victim was driven to the store when the Durham Police Department is just .8 miles away from the alleged scene of the crime."
