If he is continuing to resist yes. Your other option is to let him keep strugling until he hurts himself, hurts someone else or dies from lack of air.

you do what is reasonable to gain control of his arms and effect the arrest. his right arm was dangerously close to the officers gun side. again, for all you people who want to judge the police for being to quick to force, watch the dinkheller video and see what happens when you dont. its a terrible video it kills me each time i see it. but as a cop his death was not in vain if others learn from it and he got that scumbag off the street. you people really have no idea of the dangers cops face every time they go out

oh by the way, the officers involved were deemed innocent of any wrong doing by the department...thus proving my point

Repub, that doesn't prove shit. Cops are let off all the time by internal investigations, until the video comes out. There is no doubt that cops circle the wagons.

It turns out also that the guy on the ground had the original charges dropped for which they arrested him. He's now just in jail for resisiting arrest.

P.S. - People do tend to struggle when someone's knee is on their throat and they can't breath, and they do tend to grab arms when those arms are pelting them in the face ...

Again, I'm open minded enough to admit that 23 seconds of video is not enough to say if it's brutality or not. But it goes both ways. Your, "defend them at all costs" is also telling (and could also be a factor in why the officers were vindicated - i.e. your "proof").

Objectively, I saw a person with two cops on him, one sitting on his waist and one with a knee on his throat. I heard the officer say, "Let us put the handcuffs on you". I heard the man repeatedly tell the cops he couldn't breathe (due, I can only assume, to the knee on his throat). I saw the man with his hand on the officer's leg (to try and get the knee off his throat I assume). I saw the officer punch the man in the face a number of times. I saw the man on the ground grab the officer's arm to keep from getting punched.

From what I saw, the guy was subdued. I didn't see him struggling with the cops to escape, I saw him struggling to breathe and to keep himself from getting punched.

Again, I did say it was abuse. I think what happened before or after could determine that. But, from that short video it's tough to say what else the guy could have done. I think it's a natural response to struggle when you can't breathe, and to grab an arm that's punching you.

As far as the "I can't breathe" part, I don't buy it.

That's classic stuff right there...they always say something like that and they normally repeat it, like when they're getting the cuffs put on them, "You're breaking my arm! You're breaking my arm! MY ARM! MY ARM!"

I don't blame the people who do that, but their arm is rarely broken, and they can usually breathe.

It is scary that cops get so used to hearing that that there's a chance they wouldn't know it if they really were critically injuring someone. Cops are trained no to suffocate someone, but still...they're not doctors.

^ Yeah, I'm no doctor or expert on strangulation, but the few times I've been unable to breathe, I definately couldn't say anything, much less say it as loud as he was.

if you've ever been pepper sprayed or close to drowning you know that feeling you can't catch your breath but you can still speak.

btw sent the video to my good friend who is a durham police officer (just imed him the link didn't say anything) and the first thing he said was "that's really fucked up ".

so when other officers who deal with the same shit every day look at the tape and recongnizes there is a problem with what was happening then you know something is definatly wrong.

the durham police, despite dealing with more hardcore shit, are less corrupt than rpd. everyone knows that rpd is the worst force in the area.

they are known for having the most to prove, that cocky "respect my authority" attitude. and look how fucking many they are, you cant drive anywhere in raleigh without seeing at least 5 cars driving around. in raleigh they harass students and make up bs charges to pull people over and intimidate them into allowing searches. in durham and chapel hill you are more likely to be treated fairly, and they only harass people who are actually doing something wrong.
