i reiterate:

Quote :
"I want to even out the score. I don't like Judy especially and I want to ruin her life."

if that's all you want to do, simple:

you said she is opening a daycare, and she apparently joked to you that she would throw her kids into the pool to teach them how to swim.

ok, contact whatever agencies overlook/authorize daycares and tell them exactly that.

maybe she won't get into permanent trouble, but she will surely get into some hot water.

I mean, I seriously don't get this. It sounds like you ended this job at least 3 months ago. And now, all of a sudden, because you saw some former client you're all distressed and want to sue for vindication? It doesn't make sense.

You say you're over "Judy" (I don't believe it) but you say you are - so let her go.
Your "uncle" can be dealt with by telling him that you didn't appreciate the way he handled the situation in retrospect and asking him what he tells clients when they ask about you.

But it sounds like your real fear here is future prospects. Which, if you were to have connections from that, it would be because they like you personally and not because you answer the phone like a champ. So, that being said, if they ask what happened, tell them something positive like you left to focus on school or something like that. Even if they were told something else, they'll either not care or be cool with your answer. If they aren't, they weren't a prospective contact to begin with. Were you planning on seeking some of those people out for job contacts later on?

Seriously, don't sue though. Not only will you lose your case, time and money, but then your uncle will REALLY have a story to tell about you, and probably will, and if he ever finds out your using company information as your own professional contacts database, he'll probably counter-sue you for that.

Grow up.

If you want to ever be anything above a receptionist, you need to learn to be assertive and controlled.

You will always have a "Judy" in your work environment, being able to handle them professionally is as much of a skill as your job is.

You should have baited her into a physical confrontation (so it's not "your" fault) and then beat her ass into the fucking ground. That's the real way to feel good about yourself, regardless of what those Dr. Phil motherfuckers try to tell you.

A+ thread. Would read again.

But damn. It must suck to wake up to rainbows and a smiling sun, then have all that shattered by a rude coworker in the real world. Makes things a bit dreary, doesn't it? And if I had a job that brought in enough cheese to handle my $1000/month bills, I'd have sucked it up because paying your debt off is more important than some bitchy cowworker and what she thinks of you.

The only thing relevant legally would be a hostile environment suit. Unless you got very lucky with the judge, you would lose in court with nothing more than this.

If you want a real answer go ask student legal services! Not reading the whole thread but I read your original post and it sounds like a sucky working position. I know I could sue my former employer who let me go after I retruned from maternity leave and they let me go cuz I had a child!

Seriously, grow up. You're an adult. Handle your business. If somebody is giving you shit, don't put up with it. If you actually try to sue over this (which you won't), you basically fail at life.

Sane people don't get hysterical and leave a cushy job that their uncle set them up with in a tantrum. You will never win a lawsuit. You did not handle the situation well, this hurts you, but not as much as the basic fact that you're a whiny bitch with no case to begin with.

That's really not that hard:

Rent - 620
Cable/internet - 120
Phone - 50
Electric - 70
Gasoline - 60
Food - 100
etc.

Really, $1000/month isn't that much for someone supporting themselves. That's only $12,000 a year worth of post tax salary to spend. You can make that pretty easily at $9/hr.

didn't read most of the other replies

1. it sounds like the story falls under hostile work environment ... might need to find other people to corroborate - coworkers, clients, etc. Talk to a lawyer
2. statute of limitations concerns - 3 years is a long time, but if they're making false statements then they are misrepresenting you, which is a totally different issue. Again, lawyer.

IMO you've got a legitimate complaint - whether you'll actually get anything out of it is another issue.

I've never heard of it being appropriate to insult or make racial comments against your coworkers anywhere. That's basically the definition of harassment.

But, I do agree that it's a little late now to really get anything done about it. If you're worried about what they're telling other people, I would write a letter to your former boss (who happens to be your fake uncle) telling him about your experience and displeasure, and also your expectations if any of your future employers ever contacts him, keep a copy of the letter obviously, and keep a copy of the response, and if they try to make anything of it, THEN contact the lawyer.

But considering that you really have no evidence now (maybe you can find some people who quit?), you wouldn't gain much traction.

I can see $1,000 per month if you have a mortgage or high rent, but damn...that's ridiculous. Time to pay off some debt or something.

Thanks guys! Without any source of income, 1000+ is a lot to cover for me when I attend school fulltime as well. Maybe not for you though, so congratulations on that! I had talked to my boss numerous times about the harrassment. Also, I mentioned taking legal action right before I quit, which might be why he sent me that two weeks pay. Anyway I got some good advice that I will take, thank you!

Real life will be a challenge if you cant figure out a way to ignore or get along with others, you cant expect everyoen at every job to be sunshine. Just ignore them, make their life hell, or do something else. I fyou rtaht frendly with the boss, you can probalby get on her without him doing anything.

TWW isn't the best place for advice on something like this. And as a general rule of TWW (and life in general), the more information you give out, the more it will be used against you. Formulate it in such a way that gives it out concisely with specific intentions on what you want in return.

Anyways, go to Student Legal Services as a starting point. They should be able to direct you from there. (And for gods sake, TWW CAN be used against you in court if it comes down to it. Stop posting in this thread).

1. Stop calling women who have three children "girls."
2. If Judy was leaving, why didn't you just stick it out? Is there something wrong with you that you couldn't? Cause I can understand that.

I understand making an ass of yourself and crying and walking out of a job. That's my MO. But you gotta recognize that you're not a victim. YOU'RE A DUMBASS WHO DOESN'T HANDLE HER EMOTIONS WELL. I'm the same way. But I don't get all bent out of shape afterwards and think about filing a lawsuit. I just recognize that I'm a dumbass who needs to work harder next time to control her emotions...and then I move on.

the sad thing is that you will run into this situation at every single job you have from here on out. There will always be that one coworker that you cant stand. You better learn to deal with it now or you will really suck at life.

Thanks! I have had other jobs with coworkers I couldn't stand, but I've never felt threatened or harrassed the way I did. She is a girl, she's only 22 with 3 kids. And I'm not going to college to become a receptionist, it was just a way to get by. Finally, I understand that I could have dealt with the certain occurrences in better ways, but I felt and still feel that I took the appropriate actions and that my name should not be smeared around like it may be at the office. Misrepresentation is far worse to me than the harrassment I endured.
