Perhaps you missed that this person is black. Its no wonder they didn't get insuarance. The blacks are notorious for being uninsured. Which is ironic given all the problems/damage they cause. It would be hilarious if the apartment upstairs was occupied by whites. Then its almost like the white man up there pissing on the poor uninsured black boy downstairs. Oh the hilarity!

....and you're an AIDS-spreading faggot.

Nothing of mine was damaged. It sounds bad to say it that way, but it's shitty for my roommate, not me. I'm just sticking up for him because he's my boy, and I'm willing to fight for him because he's out of town and I know the difference between right and wrong.

This is obvious negligence on the part of the complex.

I'm glad you fuckers can't seem to see past the fact that there's no renter's insurance involved.

There wouldn't have to be.

It's like if I'm walking across the street in a crosswalk when I have the right of way, and I get hit by someone driving a car.

My health insurance isn't going to pay for my hospital bills, the guy who hit me's car insurance is.

It's the same fucking principle.

Negligence on the part of an insured party is paid for by the insured, NOT by the victim of said negligence.

Further, the repeated continuance of said negligence (lying about having sheetrock people in to repair next day, lying about having a dehumidifier in place in the morning, lying about notifying the property's general manager, etc etc etc) only provides more proof should they be dumb enough to try and test my (our) resolve.

I have documented every single bit of this, from the moment I walked in the door.

All I'm asking for is a place to live pursuant to the agreement signed by both parties. Should it continue that this place is untenable, then I've got every right to ask for them to make accomodations, and I've got every right to dictate satisfactory accomodations.

I'm sure we'll both get renter's insurance after this, but my point is that even if either of us had it to begin with, neither of us would have had to use our renter's insurance to pay for shit that is due to the negligence of the complex.

In the case of us having it, here's what would have happened:

Insurance Co. would have paid for shit to be replaced.

Insurance Co. would have found out that damage they had to pay us for was caused by negligence on the part of the complex.

Insurance Co. would sue apartment complex for damages.

Insurance Co. would be paid by apartment complex's Insurance Co. for said damages.

Apartment complex's premiums would go up, or apartment complex would get dropped from policy, either of which is a bad situation for them.

All I'm saying is that if it goes to court, which it won't, because no apartment complex is going deem that losing $1600 in rent is worth paying an extra $10k a year in insurance costs, is that we'd be cutting out the middle man.

I can't stress enough that I have been through shit like this before. If you push, you will win, contrary to all the stuff you've been fed about insurance policies. If I had a product I wanted to sell to people, I'd tell them that my way was the only way to do things, too.

Just let us know when your small claims court date is so that we can be there when you make an ass of yourself.

see the whole point that you are missing here is that this type of shit happens all the time. Your roommates shit is not the responsibility of the apartment complex to replace. IF THAT WERE THE CASE THERE WOULD BE NO NEED FOR RENTERS INSURANCE. The apartment complex already has a lawyer working for them. You are going to take on the cost of having to hire and attorney who has to prove against the testimony (if it even makes it to trial) that they fucked up while fixing the dishwasher vs it just being a faulty part or what not.

Just b/c your are some savy college graduate with major in pwning doesnt mean that a judge in raleigh hasn't seen this or an attorney for the apartment complex hasn't had a threat of a lawsuit before.

You really just need to take this whole situation as a learning experience as to choose better companies/apartment complexes you rent from as well as getting renters insurance in the future. Like I said before there is a reason why renter's insurance exists. Rental companies/landlords/apartment complexes know how the law works and if not everytime something like this went wrong they would lose big money. That is what insurance is for.

because at the time I assumed it was a broken pipe, and thus a no-fault

now I know it's an at-fault incident caused by lack of due diligence

But the apartment complex has a signed lease by you that says they are not responsible for any of your belongings.

nope. you're health insurance will pay. you might get a settlement from the insurance of the guy that hit you on top of that.

i'm not going to speculate on your specific situation, but that blanket statement is FAR from the truth.
