For Page 2:

lucky this happened before the new DEC 1st Law, which would cause you to lose your drivers license if convicted. Below are the current penalties, best of luck.

Penalties
G.S. 18B-302 (a) Selling or Giving Alcohol to Persons Under 21
A violation of the statute is a Class 1 Misdemeanor. Conviction under this statute requires a mandatory fine of $250.00 and 25 hours of community service.

G.S. 18B-302 (c)(2) Aiding or Abetting Persons Under 21 in Possessing or Purchasing Alcohol
A violation of the statute is a Class 1 Misdemeanor. Conviction under this statute requires a mandatory fine of $500 and 25 hours of community service.

Plus cost of court

the second one is just helping them get the alcohol, but not necessarily actually giving it too them like the first one.

^ Yeah no shit, but his point is why is the second one (which seems to be the lesser of the two) punished harsher?

Seems like selling someone alcohol would break all sorts of rules (this law and with taxes and shit), yet the monetary penalty is only half that of the aiding charge.

To me it seems like essentially the same violation. In this case the officer can choose how much of a dick to be (or if you are well behaved while taking the ticket you might get the lesser one). I've had friends who did the exact same thing as the thread creator (had a minor drinking off a pitcher), but instead got charged with the harsher sentence.

Also I hope you didn't tell them you were an ncsu student, because ncsu has been cracking down pretty harsh on a host of violations.

James Crouch was really expensive ($450)

My friend had the same charge and his lawyer fee was $250

aiding and abetting is used if you provide a way for people to get alcohol, so like if you have a party and there are underage people, or you provide someone with a fake id, because you didn't really *give/sell* them the alcohol but you facilitated a way for them to get it, and I believe it pretty much ends there with what they can charge you with (so they up the fine)

now if you give/sell it to someone directly they can get you on a bunch of other charges, like selling alcohol without a license, selling without a revenue license, and they can get you for aiding and abetting anything else that person does (dui, injuries to others, etc)...

also proof for the give/sell part is hard to get (unless they have a witness/video or something) so maybe they $$ more for the one they can get to stick easier? don't know

i got 2 underage tickets in 5 months back in 2003/2004.... cost me 250 to get a lawyer, total... prayer for judgment... done

I got Offense Code Description Statute
4540 Infraction POSS OPN CNT/CONS ALC PSG AREA 20-138.7(A1)
at the brad paisley concert this past july. The whole time they have continued it or I have had it continued. Today I finally figured out the guy quit the ALE because a girl had gotten busted for underage drinking, etc from him and they were like he has never shown up. So they continued hers to february 13th. So I asked for open and asked to speak to the DA. She wouldn't drop it. Judge Fullwood told me that he couldn't do anything this time but that if the cop isn't there next time it is dismissed. Lets say I get charged guilty for this infraction what would I pay anyways? total? I dont even think it was worth getting a lawyer. I went down to the record check people and they laughed about this. Let me know!

my court date is tomorrow

I ended up hiring a guy named Patrick Roberts for $200 less than Jame Crouch

my friend who was with me that night (who also got the same exact charge) got off with 15 hours of community service with Roberts as his lawyer.

I got 15 hours of community service!!!

it makes me wonder what I would have got with Crouch but I don't think it was worth $200 more than what I paid with Patrick Roberts

Either way, I'm pleased with what Roberts got me especially for the price. I highly recommend him.

Received a drinking ticket for consuming alcohol in a park of the City of Durham.

Anyone had with experience or advice? Possible angles:

1. Had not approached the 'rules' sign yet, as I was still in the parking lot (just cracked the seal and took tiny sip)
2. Rules sign has spray paint over it, making it illegible (but not the alcohol part).
3. Cop choose to trash the bottle rather than recycle although they were right next to each other.
4. ....
5. Courts profit.

As a general rule, you can not have an open container in a public area, unless it is otherwise noted i.e. outdoor concert or festival
