Quote : | "WASHINGTON (CNN) -- The Justice Department asked a federal court Wednesday to "set aside the verdict and dismiss the indictment" in the corruption case against former Sen. Ted Stevens of Alaska, court documents show.
Stevens, 85, was convicted in October on seven counts of lying on mandatory financial disclosure forms.
U.S. District Judge Emmet Sullivan on Wednesday scheduled a Tuesday hearing on the request to dismiss the indictment.
Shortly after the announcement, Stevens expressed gratitude for the prosecutors' decision.
"I am grateful that the new team of responsible prosecutors at the Department of Justice has acknowledged that I did not receive a fair trial, and has dismissed all the charges against me," he said in a written statement.
"I am also grateful that Judge Emmet G. Sullivan made rulings that facilitated the exposure of the government's misconduct during the last two years. I always knew that there would be a day when the cloud that surrounded me would be removed. That day has finally come.
"It is unfortunate that an election was affected by proceedings now recognized as unfair. It was my great honor to serve the State of Alaska in the United States Senate for 40 years.
"I thank my wife Catherine, as well as my family, friends, and colleagues in the United States Senate who stood by me during this difficult period. I also want to thank the great number of Alaskans who offered their prayers and support."
Stevens hid "hundreds of thousands of dollars of freebies" he received from an oil field services company and its CEO, Assistant U.S. Attorney General Matthew Friedrich said.
Many of the alleged free services were given as part of a renovation of Stevens' Alaska home.
Stevens maintained his innocence even after the conviction, and his sentencing was delayed amid charges by an FBI agent of prosecutorial misconduct.
Stevens lost a re-election bid in November to Democrat Mark Begich, who had been Anchorage's mayor. " |

Welp, they threw out the conviction. It appears that Stevens got the Mike Nifong treatment in his case. Glad to see the Democratic network of lies and deceit can be overturned every once in a while 4/7/2009 6:28:47 PM |

so even if the case is thrown out for legitimate reasons, do you honestly believe Ted Stevens isn't a crooked old bastard? 4/7/2009 6:42:50 PM |

The DoJ's new prosecutor is asking the court to set aside the verdict upon appeal due to prosecutorial misconduct in the first trial. He sure as hell was convicted however, and the evidence strongly suggests corruption on Stevens' part. It's simply a matter that the prior prosecutor fucked up badly enough where the new guy doesn't even want to touch the matter.4/8/2009 6:20:38 PM |

I find it amusing that the "Uncle" Ted cheerleaders here are the same ones who in other threads whine and moan about earmarks as "wasteful pork barrel spending". But I guess that only qualifies if it comes from democrats, right?

Ted Stevens only used tax payer money to build upgrades to his house. Who care? everyone does! Better to benefit our esteemed alaskan senator than to come crackhead welfare queen AM I RITE!
One of my friends from Alaska, who also voted for him last election, literally made the statement that its what every politician does...

I dont know if he is guilty or not, but if the verdict was set aside, then he technically wasnt convicted. if that conviction came on the heels of 'prosecutorial misconduct' then it isnt valid.
thats the way it works. our system does not allow it.4/9/2009 1:00:01 PM |
