probable cause =/= NEED TO GO GET A WARRANT

determination of probable cause means that the cop can request a search, immediately search, make an arrest or that they can go obtain a warrant

of course, you can refuse the search anytime a cop asks but that cop can go plead his case to the magistrate and obtain a warrant, the cop can also tell you to fuck off and take immediate actons if necessary if he feels the cause is sufficient

granted the beauty of the legal system is that "probable cause" can be determined later in court so if its bogus then it will be exposed as such


a cop just cant come to your door and be like "lemme search yo crib" and chances are if you say no and he goes to get a warrant, theyll tell HIM to fuck off

The First through Tenth articles of amendment to the Constitution of the United States is hereby repealed. If they were all that important it wouldnt have needed to be amended in the first place.

wdprice why dont you go on the website and read. All of your questions are answered there. Such as the one here. It's not a potheaded biased group, it's a former drug cop who was tired of how corruptly things were being handled.

The whole Yolanda thing is where a drug informant planted pot on this woman and testified in court that he did so yet she was still found guilty of possessing the planted pot

The case has been appealed before Judge Junell and has been denied."

The reality show team out of Austin has been setting up the fake drug den for 6 months, going through painstaking methods to keep it a secret.

"We had to use encrypted emails, we had to use Wal-Mart blowup cell phones in case our phones were tapped," said Cooper.

But why all the trouble? “Get Yolanda Madden out of prison," said Cooper.

In 2005, Odessa woman Yolanda Madden was convicted of the possession of drugs with the intent to distribute. Now she's serving a 7-year prison sentence.

"I could prove absolutely without a doubt she's innocent," said Raymond Madden

Her father says he's been trying to get a court to retry the case since the conviction.

"We had a witness that planted the drugs he testified in court that he planted the drugs," said Madden.

Cop Busters says the show exists to help fix the system.

Odessa police say the matter is still under investigation and at this point they are looking to see if any laws were broken.

We will continue to investigate the Yolanda Madden case and bring you any developments."

And as the man himself point out, just because you're a cop doesn't mean you're a good guy. Look I certainly don't think the first case with the informant sounds like everything is on the up and up at that department, but the story about this sting operation has a lot of holes, like how the cops found the place so fast (I really do find it difficult to believe that Odessa, TX has so many cops and so much money as to be able to afford having their guys cruising the streets with IR cameras looking for grow lights). Also, they claim that the cops lied on the affidavit to get the warrant, but don't have the affidavit (which I'm sure they could get if they tried).

^ I think he was more stating that your second source provides no additional information than the site does.

Also i don't think hes saying they lied to get the warrant but rather they used techniques that aren't allowed for them to obtain the warrant, thus making it invalid and a bending of the rules of law in order to get what they wanted out of it

my impression was that they set up the grow house and had it rented for a while and then turned on the lights after a while and within 24 hours of that they police came. in conjunction with that i also took it that he suspects the police used a heat detector but would not have put that as their reasoning on the report and thus used a lied on the warrant for the reasoning. could go either way. we'll see i guess.
