railways are always tied into DOT. There is nothing abusive about this; situations like this are exactly why eminent domain exists. He will be more than fairly compensated for both the cost of the land and the displacement of his business.

if this guy had an ounce of sense, he would have countered the last offer from DOT for an extra $25,000 or so under the guise of not having to pay attorneys fees to go through an eminent domain hearing

Troxler says they should find another way, not that he has any legal authority here.

It seems odd to note that the land has been with some family for hundreds of years, since it was most likely the government that granted these families the land (and excluded many groups from these grants).
