I wonder how much they paid him for the right-of-way prior to the road widening. He probably got paid for about half of the appraised value of the entire property and jumped on it, only to realize that he can't sell what he was left with for the remaining half in this economy. It's a little bit late to be bitching now.

I doubt he has any flooding issues caused by the road construction. he has half as much land draining towards his house now than he did before construction. the increase in slope shouldn't be making that much of a difference, because you shouldn't be relying on soil permeability to prevent flooding.

your opinion seems to be based on a lot of gross assumptions and some fundamental misunderstandings.

lets start with the things that can be validated. the flooding is most likely caused by the construction. granted correlation does not bear causation, but according to the home owner he did not experience any water damage until following the construction. moreover, the photos located in this very thread help support his claim. the land that was removed on his property largely had no slope until much further back as well as trees and foliage. an alteration in these two components would have a adverse impact on water drainage in any yard. grade reconstruction could easily play another role.

secondly you can't prove how much money, if any, the owner was given for the use of his land, and as such placing the burden and responsibility on him as if participating in the construction was an act of free will is disingenuous.

That depends on what the initial grades were and what the final grades are.

Contrary point: usually people find all sorts of things wrong with their property after construction projects begin or end. People *notice* cracks in their house or flooding in their yards that they never remember before construction began.

Yeah his property looks pretty raped screwed.

i'd bet almost anything that the city of Cary did not do an evaluation prior to the construction to see how potential changes could affect his water flow. it is a cost they likely skirted and now consequences for that failure are coming to light.

From the before and after picture, he definitely could be having erosion problems with a good, heavy rain. Before he had a front lawn full of trees. Now he's got just one and a steep slope of loosely packed soil. It's definitely a problem.

So, this is more of a question, but doesnt the city legaly have the right two expand its roads (up to 14' or something like that)? Do you get some sort of reimbersement for how this affects the value of your home or trees taken out? When they widened tryon rd. near university house or whatever it's called these days, they damn near put the road in people's lap.

I think "Screwed" was painted over "Fucked" or something, where most of the writing is, the house is white. Underneath both windows is dirty so we know that wasn't painted over.

The grading doesn't look very good, and he had to have his whole driveway reworked because the original path would have been too steep for most any car to climb, especially a prowler. I would assume the town paid for the driveway rework and for the land consumed, but I doubt that covered the resulting problems nor the property reduction.
