It was Progressive. And I have not followed up with them yet for a reason as to why the claim was denied.
I've been getting estimates together. I am going to get in touch with the lady personally and giver her the option to write a check for the lowest costing estimate I've gotten or I will be filing a small claims suit.5/28/2010 10:47:27 AM |

You gotta play hardball here. Start with the highest estimate (but say it's because they will be doing the highest quality workmanship). If she refuses to pay or tries to negotiate with you, you can still attempt to recover enough to pay for the lowest estimate. It would also set the basis for what you perceive to be the monetary value of the damage if this gets drawn out or you have to go any other routes.5/28/2010 11:35:13 AM |

Thats a good idea to get the estimates together and start going forward as if you are ready to file a suit. You can send it to the individual but just know that it's her insurance company that is going to be handling defense and negotiation. It's their job to defend her when they deny the claim.
See if you can get the template for a small claims suit and write it up. Send it to them and say "this is the lawsuit I'm going to file if you continue to deny my claim". Include the photo and laws she broke.
I think the picture says a lot. Its just not likely to me she was making a normal right hand turn and you came in and sideswiped her. 5/28/2010 2:16:07 PM |

Ok so if it was a two lane road, one lane in each direction, he had his right turn signal on, it doesn't matter is he was way left, your not allowed to pass a car until that car has executed what ever turn they are attempting unless he was making a left turn but he was turning right so she should of waited, 100% her fault...just my 2 cents 5/28/2010 3:43:11 PM |

you could try filing the claim again
if you were her insurance co, and you had a $1500 bill for my shitty chrysler would you just say "oh shit, yeah here you go mike take our money"
or would you deny it assuming i would roll over? i'm sure the amount of time & paperwork it took to deny your claim amounts to much less $$ than $1500
