i posted regularly in soapbox years ago. then it went to complete shit. not sure what it's like now because i don't waste my time with it. dont' usually post in cc either. but I honestly think this guy should lose this case. Not based on laws (i'm not sure what the legal precedents are), but simply because I think they should be able to set a dress code. And employees should have to follow it, if you don't meet it.. tough.
