Either way, regardless of the age if you teach or work where they go to school, its automatically against the law. You could change the law for everybody, but I think the proportion of older guys nailing students is probably far higher than the percentage of female teachers letting the football team run the train on them.

i am of the opinion this should only be illegal if the teacher is a male or a female teacher if she's ugly.

You have to make it illegal if the teacher is a male because they are manipulative and they will trick girls into having sex.

If the teacher is a female but ugly it just sets a bad example. The students will be considered toxic by the other girls at the school if they get caught boning and old ugly teacher so you have to think about their well being.

If the teacher is hot or in this case meh I think its okay. Guys can make their own decisions in high school, it's not like girls where they arent qualified usually until their mid 20's (or later in many cases).

Our society is just way too crazy about these sex laws. Hey we're going to force you to work around 500 kids and we're not going to pay you much money... now don't fuck any of them! Just a little over the top I think.

Perhaps if having sex weren't illegal for teachers it wouldnt be considered so taboo and they wouldnt be turned on by the thought of it and would only have sex with the students they are actually attracted to instead of just getting lit up by the football team.

this is true. I knew of several teachers who got "let go" and avoided the national drama. The reasons most knew why (relationships with students). Most were women teachers.

That level is about 15 years of teaching, or about 10 years plus overtime pay from coaching and other after school activities.

It's ridiculous to send them to prison just because they are teachers.

In accordance with the wishes of parents, the school essentially acts in custodial capacity, and it's illegal for custodians to have sex with their wards.

It's important to remember that children are compelled to attend school by law--sure, they can drop out when they're 16 or whatever, but everybody knows high school diplomas are vital so attendance is effectively compulsory regardless of age. Furthermore, young people have different rights at school--rights that they check at the door of the institution that they're forced to attend. If you can dictate a child's dress, you don't get to have sex with them. If you can punish them for possessing Advil, you don't get to have sex with them. If you can stop them from leaving campus without a pass, you don't get to have sex with them.

There is also the issue of grooming--teachers who take an interest in young students with the aim of having sex with them when they reach legal age. It's horrible, and we all want to pretend it doesn't happen, but yeah, teaching attracts pervs, folks.

I suspect that some people who oppose criminal penalties for these teachers must have very low expectations or opinions of teachers or the profession. In my understanding, teaching is an important calling that involves a tremendous amount of trust on the part of students, parents, taxpayers, and society. At the very least...as long as students are legally required to attend a school where they lose many of their rights, it should be illegal for the empowered agents of that school to have sex with them. This is pretty basic stuff.
