Yeah, if this case is as open and shut as it sounds from the news reports (hah), then he'll likely plead to life in prison to escape the death penalty, or high end 2nd if they'll let him, we may never see a trial for this one. I could see them pushing for death in this one, but who knows.

Obviously they won't charge him with 2nd--but if he gets charged with first, non-capital, and the trial looks extensive, or it doesn't look like they've got a ton of evidence, they may allow him to plead to second. It's not likely, but it's possible. It's more likely he'll plead to first, with possibility of parole. It just depends on how much they want to get out of him, and how much he wants to go to trial. If I were him, I wouldn't want to go to trial if I had a plea deal waiting for me.

Although, since they're in Texas right now, I wonder if Texas will give them up to North Carolina, if they're not going to put DP on the table.

The evidence is probably pretty damning, considering the speed at which this is moving along. I see this as NOTHING like the Cooper or Young murder cases/trials where they needed (wanted?) to build enough evidence prior to bringing murder charges against the suspects.

Compare this to the girl who was raped and stabbed by the two black guys over off Gorman a few years back. They has those suspects in a very short matter of time, and IIRC one of those idiots was the last person to be convicted in this state in a capital murder case. I think we have a strong possibility of capital murder charges against one if not both the Hayes suspects here (the most solid case against one of them would be to have one plea to a lesser murder charge and testify against the other)

He was just processed in Raleigh, according to WRAL.

And I'm sure they have so much evidence it's ridiculous. Motive, supply receipts, evidence putting him in Richmond, TX...there's probably all kinds of blood evidence.

However, I don't think he'll plead anything, and I also don't think he'll get the death penalty. There's a hold on death penalty cases or something, and prosecutors aren't generally going after it these days anyway.

^^There's a DP case going on right now in Wake County, so they do happen still. (Doesn't mean I think they'll pursue it here, just a possibility).
