My question is why don't these train stations have overpasses for people to get from one platform to the other? Just seems like a bad idea to let idiots have open access to the train tracks in the first place. 1/22/2012 3:25:36 PM

looking at the station on google maps, it is a giant clusterfuck. ground-level railway running through a residential area with no fences of any sort. bad plan all around 1/22/2012 3:27:31 PM

Thinking about it it seems like both the mother of the guy and the injured woman could argue in court that the station doesn't provide safe crossing for passengers giving them at least partial negligence. The whole argument of the station wasn't announcing the guy's train was late seems like a dumb angle to take if you're looking to pin them for negligence. 1/22/2012 3:31:36 PM

You guys realize to cross these tracks to get to the other side you would have to jump down close to four feet from the platform then climb back up four feet on the other side. Crossing the tracks to catch another train there is plenty of access paths above or below the tracks. I think there is a lot of trolling going on in this thread. 1/22/2012 4:03:11 PM

have you even looked at google maps, man? this crossing isn't the safest place, and he could have easily run across the tracks at the intersection just 50 feet away from the station 1/22/2012 4:04:27 PM

The biased article itself is especially misguided:
Quote : | "It's not like this kid had millions -- what is she hoping to gain from this lawsuit?" |
You sue based on your own need, not based on the extreme wealth of the offender.
It's hilarious. The author thinks he's advocating some sensible stance on litigation, and instead, he/she is promoting the worst instincts in society. You don't sue somebody just cause they're rich. 1/22/2012 4:28:41 PM

yeah, but if they don't have any money, and are dead, what the fuck is the lawsuit accomplishing, other than to put more stress on the family and waste society's time and money 1/22/2012 4:30:13 PM

It's already been pointed out that there are places where you can get money from an 18-year-old. My parents used to lecture me about them all the time. 1/22/2012 4:38:37 PM

look at Doc Rambo IV all high and mighty accusing other users of saying shit they didn't say. I've got no problem with people suing other people for negligence and the like. I do have a problem with people suing other people who are dead and probably have no money to be gained anyway, thereby wasting everyone else's time in the process 1/22/2012 4:54:09 PM

^^ That's my problem. I don't think the kid's parents should have to foot the bill, which is what I'm assuming this broke-leg old bitch is going for.
Now, if they got a payout from the train station, and she didn't, and she's suing them to recoup some of her losses out of that sum, then I can accept that. 1/22/2012 4:54:10 PM

I see nothing to indicate that this kid has any money. he's riding public transport in Chicago and is too stupid not to run across train tracks without looking for a train in the first place. now, if you've got information showing that he's loaded, feel free to share it, but the circumstances of the situation sure tell a different story.
as for the house, what the fuck? where did I say I was gonna walk away from my house just cause I got laid off? I actually tried to work with the mortgage company, who just turned around and told me to fuck off after telling me to keep burning through my savings to make the monthly payments because it "gave me more options." You are god damned right I'll fuck up someone who cares so little about another person. fuck them. 1/22/2012 4:59:44 PM

That's what everyone's mortgage company says...I don't even want to be mean about it.
But, I'm saying, aaronburro, you understand what it means to have troubles. You've talked about them on here. And if somebody's body parts popped out of nowhere and messed you up at a rough time in your financial life, you would sue, too...and you know it.

not if the fucker was dead broke, I wouldn't. I wouldn't waste my time.
and no, a mortgage company shouldn't lie to you when you are having hard times. seems like a reasonable thing to say "do what you can, we'll see what we can do." Saying "hey, keep paying, it looks good" and then turning around three months later and saying "well, you are still paying so you don't need help"... that's just callous.

There are not enough eye-rolls for this.
They all keep telling to you pay. They don't care about how you pay...only that you continue to pay. You think they give a crap about maintaining your savings account?!?! LOLOLOLOLOLOL They'd prefer you sell off all your belongings and empty your retirement accounts before you stop paying them.
That's kind of how loans work. LOL 1/22/2012 5:09:56 PM

that's fine. don't expect me to like it when you lie to me, though. If they had foreclosed, I would have torn the house apart, though, because of it. It would have cost them at least 40k to fix the place up enough to where they could have sold it as a foreclosure. fuck them. I guarantee you SECU wouldn't treat people like that.

Well, that's kinda what I'm saying.
You're all kinds of comfortable with less than honorable behavior on your own part.
But then you get super high and mighty drawing lines in the sand for everybody else.
The experience you had with the bank should make you more sympathetic to people in surprising and desperate circumstances. 1/22/2012 5:16:33 PM

I'm not getting high and mighty, though, that's what you are missing. I don't give a fuck if this bitch sued a guy who she could actually get money out of, assuming the guy actually harmed her. It's obvious that this dumb kid hurt her. But, more than likely, this kid is flat broke, in more ways than one. Suing his corpse accomplishes nothing, and that's what I don't like. I'm not fussing on account of some high morality here. I'm complaining because she is wasting the tax dollars of people suing a guy who is dead and probably has no money and will have no money. Guess who foots the bill for that? the taxpayers. and all the while, she is heaping more pain and suffering on the family, just so she can get their kid's Xbox360. 1/22/2012 5:22:01 PM

I have been to train stations before where it's just a dirt path between the two platforms rather than any overpass or tunnel. The article doesn't really explain if he was jumping the tracks or if he was crossing at a designated crossing point. 1/22/2012 9:38:34 PM

looking at it in google street view, there's a sidewalk that was specifically laid through the tracks, not to mention another sidewalk crossing a nearby major thoroughfare. bad design is bad 1/22/2012 9:43:00 PM

wolfpackgrrr All American 39759 Posts user info edit post |
Yeah that's what I'm seeing too. It doesn't make sense for a busy station to have a layout like that. If I were a lawyer, I'd take the angle of whatever company manages that station doesn't provide safe crossing points and therefore shares some negligence for this incident. Now if this station has a tunnel that we're not seeing that the kid could have used to safely get to the platform, then I wouldn't see how you could sue the company. 1/22/2012 9:46:10 PM
