30 years, has yet to run opposed (to my knowledge), failed to prosecute Johnny boy for his crimes in wake county, currently trying to cover for Gov. Bev Perdue's shenanigans and claiming the good gov. "did not know the flights she was taking were being payed for by illegal campaign contributions"

His refusal to intervene on any law enforcement officer criminal activity. There is a reason the former wake county sheriff (Mr. Baker) was replaced by a former highway patrol trooper who spent "26 years working wake county exclusively" (donnie harrison)

Colon lets police in wake county get by with murder (literally) and turns a blind eye to criminal police conduct.

Arrests in wake county have dropped DRAMATICALLY since 2012 started. If you dig a little deeper you find some interesting facts.

Donnie's Mickey Mouse sheriff's department formerly had a written department policy that ALL deputies were REQUIRED to arrest and process any citizen who was accused or charged with a crime. Caught walking down the street with a joint in your pocket? Taken to jail. That policy has since been ammended with no explanation of why it was in place or why it was changed.

The purpose was to stack the jail full for federal funds. The county is currently securing funds from a federal grant. In order to obtain funds, there has to be an 80% conviction rating for all arrests that fall under the guidelines of the federal program the county is currently participating in.

Donnie's dumbass deputies arrested a strung out kid for pot posession and he died in an over-crowded jail. The county is already the focus of 2 federal lawsuits and around the court house water cooler is talk there are several more in the works due to Donnie's mishandling of the department. Colon just turns a blind eye and tries to prosecute whatever Donnie brings him. Also, Colon loves judges from Wake County who were former law enforcement officers.

Taft's sister, Dina Holton, discovered her sister, bloodied and bandaged, unresponsive hours later and called 911, initially thinking she was suffering from complications from the surgery she had a day earlier.

It wasn't until Taft's plastic surgeon, Dr. Ronald Riefkohl, examined her at WakeMed that it was learned she had been attacked.

"As I removed the bandage, I immediately found a huge defect in the left side of her scalp," he testified.

As he was examining Taft, he and other medical workers suspected she had also been raped.

"I just knew something was bizarre, and I went back outside and told Dina, 'There's something strange here.'"

Defense attorneys for Williford, who could face the death penalty if found guilty of first-degree murder, don't dispute Williford attacked Taft but contend that he isn't guilty of first-degree murder because the crime wasn't premeditated.

The unemployed, amateur musician had been drinking, doing drugs and had been out to get an adrenaline high when he broke into the home where Taft was staying, his attorney, Ernest Conner Jr., said in his opening statement Wednesday.

The combination of alcohol and drugs combined with a variety of mental disorders, Conner said, made Williford incapable of forming the necessary mental intent to commit first-degree murder.

"It created the perfect storm of terrible conditions in Jason's mind," he said.

It's about a person who couldn't plan because of his mental illnesses and his sexual and drug and alcohol addictions. It's a case about diminished capacity, and it's a case about the consequences of untreated mental disorders.""

Probably because they want life in prison and not the death sentence. So, there was no plea deal offered. If they're not going to offer you a plea deal, then they still need to prove the facts of their case.

Jason Williford’s capital murder trial took a dramatic spin on its fourth day when Jessica Foote, the spouse who has since filed for divorce, also said he tried to rape her in their Raleigh apartment only five days before his arrest in Taft’s slaying.

Foote, her dreadlocked hair tied back in a multi-colored bandana and with multiple piercings in her face, stood in stark contrast to the uniformed officers and suit-clad investigators who have already taken the stand. Now working as a fire-eating performer in Wilmington, Foote told jurors she loved Williford when they married in 2009 and that she initially considered him innocent of Taft’s murder – framed by police who couldn’t put the case together.

By April 2010, weeks after Taft’s death, the neighborhood where Williford and Foote lived off Oberlin Road had been covered by police seeking DNA samples, which Williford had refused to supply.

Foote said she didn’t report being attacked by her husband until many months later. “In the back of my mind, I didn’t think it would look too good with what was going on in the neighborhood,” she testified.

Williford, 32, kept his eyes lowered throughout the testimony – his demeanor throughout the trial. He stands accused of entering the nearby house where Taft was staying and sexually assaulting and bludgeoning her in bed as she recovered from cosmetic surgery. Taft, a 62-year-old Greenville resident, was a long-serving member of the State Board of Education.

Foote described her husband as “pretty drunk” on the night of Taft’s murder. But she said the drunkest she had ever seen him was a few weeks later, when he held her down on a bed and put his knee between her legs.

“I kept screaming, ‘Jason — get the (expletive) off me!” Foote testified. She said her husband responded repeatedly, “Or else what?”

Foote said Williford left before completing a sexual assault, and that she had attempted to reach a large, military-issue Ka-bar knife she kept between the mattress and box springs.

“I probably would have really hurt Jason, if not killed him,” she said.

Drunk and loud

On the night Taft was killed, Williford came home at midnight with a friend named Dan, both of them visibly intoxicated, Foote testified. They were noisy, playing guitar and “air drums,” stomping on the floor. Foote said she was furious because she had to go work at her veterinary technician’s job in Durham early the next day.

At the time, she said, the couple had three dogs and seven ferrets in their home.

Williford wasn’t working and had often been unemployed, she said. She had thought him to be sober earlier in their relationship, though she knew of his trouble with drinking and had attended Alcoholics Anonymous meetings with him.

When Williford took his friend home, Foote said she warned, “Be sure to be home before 3 a.m., because nothing good ever happens after 3 a.m.”

He returned home around 2:45 a.m., but left their apartment after she confronted him about “blatant disrespect.” She thought he was only smoking a cigarette, she said, but Williford was gone for a long time.

When he came home later, “He was in his boxer shorts. That was it.”

Cross-examination

On cross-examination, defense attorney Michael Driver asked Foote if she remembered describing her husband as a “gentle soul.”

“My mom described him as a gentle soul to my family members who didn’t know him very well,” she said. “She did not know him well. ... I don’t think I ever used those words.”

Driver also had Foote read jurors a letter she wrote to Williford shortly after his arrest, which referred to “when the truth reveals what a wonderful man you are” and promised “we will see each other soon because you are innocent.”

Foote described some of her statements to investigators as a defense mechanism made when she didn’t know what was happening. Williford never suggested problems other than alcoholism, she said, adding that she didn’t know he had been hiring prostitutes and arranging sex with men on Craigslist.

“Jason had a secret sexual life that you just didn’t know about?” Driver asked.

“I did not,” Foote replied."


Sounds like both of them were off their rockers.

I don't think anyone has accused him of being charming.

He dresses well because his attorney tells him how to dress, and someone from the law firm brings his clothes over every morning.

Witnesses don't get their clothes picked out for them, but the prosecution sure as hell tells their witnesses to look presentable.

Dude is guilty of murder 1 in my book. I don't even see the point of calling out all his sexually abnormal behaviors at pubescence on. I'm sure there's more people than you know that go through things like that; especially those that later on identify as homosexual. Doesn't make them rape and murder though.

I read her name and imagined how Foote was kind of an unattractive name. Then saw her, and realized it suited her. I mean she probably stinks too, dreads and all, for gods sake she kept FOURTEEN fucking ferrets in her house.

Jason Keith Williford, 32, is charged with first-degree burglary, first-degree rape and first-degree murder in Taft's March 9, 2010, death.

The longtime state school official was recovering from surgery at a friend's home in Raleigh on the morning of March 6, 2010, when, prosecutors say, Williford intentionally broke into the house, beat her in the head with a blunt object and raped her.

Defense attorneys don't dispute that Williford is responsible for her death but claim he was acting under a diminished capacity stemming from a variety of mental disorders, including alcoholism, impulse control disorder and sexual addiction.

The attack was not planned, they say.

The defense's last witness, Ann Burgess, an expert in crime scene classification and offender typology, supported that claim with her testimony Tuesday that the scene of Taft's attack was not representative of a crime that was planned.

For example, she said, DNA that ultimately led police to Williford, was left at the crime scene, and there were no attempts to cover up the crime.

"There's a spontaneous, unplanned quality," she said. "My opinion is that he did not have a plan to rape or murder on that night. He certainly broke in and had wanted to break into an unoccupied home where he could play out in his mind the power control dynamics that he suffered from."

But prosecutors called Dr. Nicole Wolfe, as a rebuttal witness, who testified that although she diagnosed Williford with mental disorders – including alcohol dependency – she found nothing to suggest Williford was suffering from any kind of severe mental illness at the time of Taft's attack.

"I do not believe he had a mental disorder that prevented him from being able to make and carry out plans," Wolfe said.

Williford has a history of breaking into homes, she noted, and that it often involved some kind of sexual component, whether it was calling phone sex lines or watching pornography.

His actions during and after Taft's attack also suggested to her that he fully realized what he was doing and could control his urges and make decisions.

Despite multiple requests, Wolfe said Williford never spoke to her about the crime, and it wasn't until after her evaluation that she learned details he shared with mental health experts who testified for the defense.

Among those details were that Williford went home after the attack, washed his clothes and buried a pair of bloody socks.

"What he said about what he did afterwards was extremely telling," she said.

Another factor that led to her opinion, Wolfe said, had to do with "incredibly violent" images in books that Williford's parents took to him while she was evaluating him at Central Regional Hospital in Butner earlier this year.

One of the images portrayed a woman being assaulted with a stone to her head.


"It was just one factor that I considered, but I was just shocked that someone would have this level of graphic violence brought in while they were having a pretrial evaluation on a charge of murder," she said.

She felt so strongly about the photos that she attached the images to her report that she submitted to the court.

"My conclusion was that he liked violent material, which he had denied to me," Wolfe said.

Defense attorneys are expected to cross-examine Wolfe on Wednesday morning.

Also expected Wednesday is a conference between the defense, prosecution and judge on how to instruct jurors when it comes to deliberating the case."

Of course they have to let the jurors consider 2nd. If they don't, and they come back with just plain first, that could be reversible error. You used to always have to instruct on 2nd for capital cases, now it's usually done, but it's not mandatory. Just covering your asses really.

And on that ^ note, there are cases that state becoming intoxicated specifically to erase intent does not erase intent. However, involuntary intoxication, or voluntary intoxication that ends up with a result you didn't intend can, but usually won't, negate intent.

I really don't see him getting anything but a first degree murder conviction; especially considering that it happened during the commission of two other felonies.

It's also cases like this that really try my opinions on the death penalty, but I will say this:

Out of curiosity, I looked at the records of some of our state's 156 death row inmates, and I feel like Williford did a lot more than some of them did to get there...
