Because they're both class 2's? Yeah, rape and robbery are in the same boat, too.

There was a guy I was trying to hire a few months ago, absolutely brilliant, and I offered him the job. However, when HR did the background check, he failed because of a conviction for 'excessive speeding.'

I tried everything I could to overrule that, because, well a speeding ticket is a bullshit reason not to hire someone but HR wouldn't budge on it even after getting people above me involved.

So yes, having a clean record is worth the money.

Anyone who suggests taking care of more than a "9 over" or non-moving violation charge by yourself is an idiot.

Really? I mean honestly these days I'll always hire a lawyer, but what's the harm in going and getting it reduced from a 13 over to a 9 over by yourself?

I think the point is that you just never know when you're going to run into a shitty judge or a cop having a bad day. 90% of the time you can get anything between 10 and 15 reduced to 9-over...but you might come up on a judge who doesn't like that you wore jeans and a t-shirt to court or he saw you texting after he told everyone to turn off their phones or something along those lines.

If you want to 99.9% guarantee that you get out of something or have something reduced, it's your safest bet to hire an attorney. That's all.

Improper equipment, faulty muffler, etc.

Wake County does not reduce moving violations to non-moving violations. Other counties will do that though.

^To add to that, some officers come to court and testify to every speeding ticket they've ever written. Most people don't know what to do in that situation.

Cop or judge? Now sure I haven't done this in a few years, but back when I did I always dealt with an assistant DA, and they always reduced. Worst case if they don't can't you just ask for a continuance for whatever reason, like raising $ for the fees?

I've got a speeding ticket to deal with tomorrow morning. Planning to arrive early and talk with the DA about it. Hoping not to have to address the judge at all.

So I imagine the Crouch train has pulled into it's last stop huh?

Quote :
"RALEIGH, N.C. — A Wake County District Court judge on Friday submitted her resignation to the governor amid a state investigation into how she handled a dozen DWI cases.

Superior Court Judge Donald Stephens asked the State Bureau of Investigation in February to investigate Judge Kristin Ruth after District Attorney Colon Willoughby wrote to him about "unauthorized scheduling" and "unusual judgments" in the cases.

The defense attorney on record in each case was James Crouch, whom Willoughby accused in January of misconduct.

In addition, Willoughby wrote, Ruth gave limited driving privileges in three cases in which the defendants were not eligible. Those cases were also tied to Crouch.

In a statement released by her attorney Friday, Ruth said she has cooperated fully with the investigation and acknowledged that she signed numerous orders for Crouch that should not have been signed.

"I must admit that, because I trusted Mr. Crouch, I did not read the orders when they were presented to me," Ruth said. Had I read the orders, I would not have signed them."

Her resignation, Ruth said, "is necessary to maintain the integrity of the judicial system."

"I have served the citizens of Wake County in a manner of which I am proud. It was an honor to serve for 13+ years," she said. "Although my misguided trust of Mr. Crouch has resulted in my resignation, it should not reflect on the integrity of the judicial system of Wake County or the state of North Carolina."

Ruth did not have any additional comment, nor did her attorneys, Rick Gammon and Joseph Zeszotarski Jr.

In Crouch's case, Willoughby filed a motion for appropriate relief against him on Jan. 29 in the case of 16-year-old Henry Horne.

Horne, who was arrested Dec. 10, was given a court date of Feb. 13, but Crouch showed up in court on Jan. 20 and told Judge Keith Gregory and an assistant prosecutor that the prosecutor's supervisor agreed to put the case on the court calendar for that day, according to Willoughby's motion.

In North Carolina, only prosecutors have the authority to set trial dates. The assistant district attorney's supervisor, however, never authorized the Jan. 20 court date, Willoughby said."

I am pretty sure he can still handle a speeding ticket.

You'll get passed off to another attorney, you will probably not have to pay any more than you already agreed to if he does get suspended or disbarred.

I don't think so. But presentments are never used... and why are they investigating the legal assistants? Craziness. But, he's got Cheshire on his side, so we'll see how far this goes.

From WRAL -

Just came here to post that^

Working for law abiding good attorneys I've always hated James crouch! Glad he finally is getting what he deserves.

James Crouch got me out of charges for speeding and reckless driving a couple of years ago. Now I'm wondering how legit it all was, but I'm not regretting that I hired him.

He continued it four times or something before they final dropped the reckless driving and reduced the speeding to under 9 over. I was just glad I didn't have to go to court. For me, a few hundred bucks to a lawyer is worth not having to take time off work to go to court, but I realize not everyone feels that way about it.

You can't be trespassed unless you refused to leave after being asked by the police as far as I know. As for the resisting arrest I am not sure on that one given I wasn't there to witness it.
