Oh, I have no justification, and I don't agree with the premise of felony murder as murder in the first degree. I'm just explaining the legality to you and how it functions in our society.

However, the law would say if you intended the burglary, you vicariously intended every foreseeable consequence.

It may be three years too late, but I just wanted to share that Beethoven is an idiot and Felony Murder conviction has nothing to do with the foreseeability/intent analysis, as its application is restricted to a causation analysis in virtually every jurisdiction. He blended 1st deg murder / FM together in a way that is mind boggling (likely due to reading wikipedia).

I completely believe him when he said that he does "not go to law school."

The doctrine is premised upon the lack of intent. He correctly stated that "premeditation" is not required (as would be required for a 1st deg murder conviction), and he is on the right track, but the legal theory is based on imputing intent to the co-felon even if there was no foreseeability or intent to either kill another human or that another human would be killed.

Beethoven said

When the actual rule is that the court will examine whether the actions of the co-felon both proximately and actually caused the death of another. The foreseeability analysis is taking it a step too far as the common law analysis examined whether the felony committed was (1) inherently dangerous to human life and (2) whether the co-felon proximately and actually caused the death

Courts never reach a foreseeability analysis because the Felony-Murder rule is dispositive as to whether or not it was foreseeable that death would occur. The offense is restricted as to whether or not someone committed a felony and then died as a result, not if it was foreseeable, otherwise there would be no rule.
