"they are going to get Crouch on the same shit they got Lee Hatch and others from JOCO on, I bet.

im not 100% sure but i think they were doing similar shady shit. but im too lazy to look it up."

the Chad Lee and Lee Hatch debacle was a little more brazen, stupid and offensive to the system, imho. those DWI's just basically disappeared in exchange for cash. they could have got 50 years in prison, but received around 5 and permanently lost their law licenses.

the Crouch method was sneaky, but not as bad and the end result wasn't as bad. (these folks were still convicted of their DWI's). difference being, i get the feeling they really want to nail Crouch. it wouldn't surprise me if he ends up with a couple of years behind bars himself.

The original blurb had them all being charged with conspiracy, which is why I wasn't thinking they were appropriate charges.

^ gotcha

these cases are going to be entertaining. as entertaining to me as the young/cooper trials, but that probably won't be the case for the general public so the coverage will be lacking, i bet.

Toast because they hate his guts, or toast because they have a good case against him.

Quote :
"Crouch is not the only lawyer in Wake County to seek “nunc pro tunc” rulings — Latin for “now for then” — that allow the backdating of convictions.

The process allows a judge to backdate a conviction and is often used in benign circumstances to fix clerical errors. The process is typically initiated when a defendant’s attorney files a motion for appropriate relief, which has a space on the form for a prosecutor’s signature.

But in the dozen cases in question with Crouch and Ruth, there is no such paperwork. Almost always, a judge corrects his or her own order, not that of another judge.

Read more here: http://www.newsobserver.com/2012/06/26/2160778/wake-grand-jury-indicts-former.html#storylink=cpy"

See the practice they were using is not necessarily illegal. Keep in mind the judge signed off on these things....its not the attorneys job to make sure the judge understands what they are signing. If he had forged a signature or something it would be different but that does not appear to be the case.

This guy has done some excellent legal work, he got a state trooper that was profiling young women for traffic stops removed, and some people re-assigned at the jail that were accusted multiple times of roughing up inmates.

you're right, nunc pro tunc motions are common place... but not the way that Crouch allegedly did them. the way he is said to have approached them, without MAR's, were arguably fraudulent orders.

obviously, we'll wait to see Crouch's defense to those claims. that's why i think it will be an interesting case. right now, much like when the JoCo guys went to trial, it doesn't look good for his side.

in regards to crouch and the judge, i've seen the two of them out together- just them- on a few occasions. Usually after 9, getting drinks at places like Poole's diner and Bloomsbury Bistro.

I am not certain if he is married but to me, the outings did not seem platonic, to me.

EDIT:

I also think he is a fantastic lawyer. I've seen him in action and he actually has a really close relationship with the DAs, as well as judges. Hell, even some police officers. They're not going to go after him to go after him.

I've got $5 real dollars that says he gets out of it. I'll take that bet with whomever.

She is married. And most Judges go out downtown with attorneys. I highly doubt she was having any sort of romantic relationship with him.

I also think they'll all get out of it.

I suppose you're right, most lawyers do go downtown with judges of the opposite sex for drinks at nice restaurants, lasting well into the evening and consisting of no one but themselves.

i know you're probably joking but even the best lawyer needs a lawyer, you're not capable of taking yourself out of the picture and doing the job 100% like it should be done when it's your ass on the line - now doesn't mean you can't help

I mean he is not Joe Cheshire, but the average guy can not afford Joe Cheshire, which is another reason why Crouch is the man, one of the best reputations in town, totally reasonable rates.

his nephew is, or at least was, a TWW member. When I hired him in 2005 he asked how I got his name. I told him TWW and he said his nephew was on here and that his nephew had mentioned his e-cred to him.

Does this mean more irresponsible drunk drivers will lose their licenses? Because if so I call it a victory for drivers in Raleigh.

I just read the updated articl in N&O.

They were going to fight the charges up until last week, when they found out documents had been altered and there was another layer to it that was much harder to defend.

Quote :
"“It’s an amazing fall from grace for James,” said Joseph B. Cheshire V, the Raleigh attorney who defended him. “It’s been a hard fall that he will acknowledge at the time of his sentencing is one of his own doing.”

Defense attorneys Cheshire, Brad Bannon and Alan Schneider were ready to fight the charges lodged against Crouch in July. But last week, the team discovered that Crouch had altered records from some of the DWI cases at the crux of the allegations, doctoring the documents after he had already been accused of obstruction of justice.

The attorneys had turned over the financial documents to Wake County district attorney, not realizing that their client had altered his law firm files and billing statements for DWI cases already under scrutiny. The changes were intended to hide his practice of charging from $500 to $750 extra to get convictions backdated, a change that often reduced penalties for his clients.

Cheshire and his team confronted Crouch, and he acknowledged altering the records, they said. They informed the district attorney that they had unknowingly provided him with doctored documents. They also notified the State Bar, which oversees North Carolina lawyers.

“When something like that happens, the case is essentially over,” Cheshire said after the plea hearing. “We were preparing for trial, but the world changed last week. It was a stunning week last week, just a heartbreaker.”

Crouch had an active role in getting this pervert cop fired.

He was known to patrol Trailwood drive in search of females to pull over, arrest, and proposition for dates. This trooper had an abnormally high arrest rate for females, twice as high as most officers.

Crouch is a good guy. It's too bad he chose to make a few extra bucks illegally.

It'll be tough to earn a living from here on out. I imagine that they'll be taking his license to practice as part of any plea arrangement.

If you have him as an attorney, I would be attempting to get some of my money back and giving it to John Fanney or some other DWI guru.
