No, because that's not what she said. She said "Mommy's getting a spanking for biting." Daddy wasn't mentioned anywhere in the same conversation as the spanking or the doll play. And the Judge ruled any statements regarding her daddy, like the "Daddy gave all the animals fruitsnacks" that she said in a later conversation, will not come in.

Thats what I thought, so in theory the jury can only use the testimony to determine that Cassidy saw her mothers unidentified attacker.

basically the prints didnt match Jason Young.
There were foreign DNA samples.
Woman saw another car in the driveway that morning.
He had the ability to open the door without the key.
...just all kinds of stuff that would lead you to believe he is not guilty.

I guess I just don't get it, but how is the state allowed to add another charge like that? How can they look at anyone with a straight face after declaring for weeks on end that "THIS GUY DID THIS TERRIBLE THING AND IT'S REALLY THIS TERRIBLE!!!" and then come in at the very end and say "well, consider that maybe it wasn't really as bad as we said and convict the poor bastard anyway..." how in the fuck is that fair at all to the defense?

No, there were only three dolls. There was a hispanic "Mommy doll" with dark hair and a purse. A white old lady doll. And a doctor doll. She chose the Grandma doll to beat up the Mommy doll.
^There was testimony that Cassidy Young (2 years old) did a reenactment of the murder at day care. She used the Grandma doll to beat the Mommy doll with a chair while the Mommy doll was in the bed. She allegedly told the day care worker "Mommy's getting a spanking for biting."

are the prosecutors actually saying this? that's grounds for dismissal with prejudice, IIRC (whatever the right legal terminology is). seriously, the SC, no less, has ruled that you can't fault someone for invoking his 5th Amendment rights and imply that doing so makes him look guilty. what the fuck. can the defense object during closing arguments if the prosecution is committing such misconduct, or does the defense just have to mark it down and bring it up later? 3/1/2012 4:48:15 PM

Judge ruled they could use his unwillingness to talk to the police as "weighing on his credibility" but not "evidence of guilt."
Same Prosecutor did it in Cooper too.
