what we need to do is compare these shoes to the shoe print at Nancy Cupper's body dumping site. there must be a way to connect Brad Cupper to this case, too.

I think the three day care workers who testified this morning did damage to the defense. The jurors were given instructions not to use the testimony as the child being able to identify the assailant...

Which means they'll immediately use the dolls to identify the assailant

Did they testify that Cassidy said anything about "daddy" punishing mommy for biting?

No, because that's not what she said. She said "Mommy's getting a spanking for biting." Daddy wasn't mentioned anywhere in the same conversation as the spanking or the doll play. And the Judge ruled any statements regarding her daddy, like the "Daddy gave all the animals fruitsnacks" that she said in a later conversation, will not come in.

Thats what I thought, so in theory the jury can only use the testimony to determine that Cassidy saw her mothers unidentified attacker.

I wonder does Tylenol Rapidblast taste like fruit snacks. If so, how would you even present that in court?

basically the prints didnt match Jason Young.

There were foreign DNA samples.

Woman saw another car in the driveway that morning.

He had the ability to open the door without the key.

...just all kinds of stuff that would lead you to believe he is not guilty.

They reallllllllllllly busted the prosecutions case today.

Closing arguments today. Each side has an allotted 3 hours. Defense will go first.

Even if Young did it. I hope he gets off. Just to spite all those hateful websleuths hags.

they allowed a second degree murder instruction.

that's not good for a defendant facing a waffling jury....

I guess I just don't get it, but how is the state allowed to add another charge like that? How can they look at anyone with a straight face after declaring for weeks on end that "THIS GUY DID THIS TERRIBLE THING AND IT'S REALLY THIS TERRIBLE!!!" and then come in at the very end and say "well, consider that maybe it wasn't really as bad as we said and convict the poor bastard anyway..." how in the fuck is that fair at all to the defense?

i mean, I suppose the defense just expects it and argues the whole way based on that, but damn

the judge allows it, not the state. he is the one that can say ok, yeah...you can have this option too.

I think there are just way too many coincidences that point to him. However, I did say that the state did not really prove it beyond a reasonable doubt, which means they did not meet their burden.

^^ and for whom does the judge work, again? riiiiiiiight, the state. i realize there is a distinction, but to act like the prosecution and the judiciary aren't connected at the hip at this point is to border on delusion.

^WHY DON'T MORE PEOPLE REALIZE THIS???
Ugh, it's just frustrating. Because you hear all freaking day long how "the defense has to pay their experts to testify" but what do you think the prosecution does? Do they think the SBI, CCBI, FBI, LEO all work for free? It's all so heavily slanted in favor of the prosecution from day 1 that it makes me want to scream.

correct.

and coincidences dont make murderers. If anything there are more coincidences with his sister in law doing it than him.

This could totally be pinned on her. She's way too suspicious, and she's lied more about her whereabouts that night than Jason did.

Yes, it's a joke. I really dislike those self-righteous websleuths crazies though.

I don't think the State has proved it beyond a reasonable doubt. Completely satisfied? Entirely convinced? Nope.

I cannot believe that he is getting blamed for NOT talking to police. you have a RIGHT not to say anything to them...and now you are getting criticized for your right?

Sorry, someone please explain the dolls to me. I am not watching the case right now.

Are they just doing reenactments with dolls or something.

No, there were only three dolls. There was a hispanic "Mommy doll" with dark hair and a purse. A white old lady doll. And a doctor doll. She chose the Grandma doll to beat up the Mommy doll.

^There was testimony that Cassidy Young (2 years old) did a reenactment of the murder at day care. She used the Grandma doll to beat the Mommy doll with a chair while the Mommy doll was in the bed. She allegedly told the day care worker "Mommy's getting a spanking for biting."

are the prosecutors actually saying this? that's grounds for dismissal with prejudice, IIRC (whatever the right legal terminology is). seriously, the SC, no less, has ruled that you can't fault someone for invoking his 5th Amendment rights and imply that doing so makes him look guilty. what the fuck. can the defense object during closing arguments if the prosecution is committing such misconduct, or does the defense just have to mark it down and bring it up later?

Judge ruled they could use his unwillingness to talk to the police as "weighing on his credibility" but not "evidence of guilt."

Same Prosecutor did it in Cooper too.
