Raleigh, N.C. — A man who was supposed to play tennis with Brad Cooper the day his wife disappeared says in a new court filing that police tried to "coerce" him into saying he helped establish an alibi for Cooper, now at the center of a custody battle for his two young daughters.

In an interview with police four weeks ago, Michael Hiller states in an affidavit, investigators used "good cop-bad cop" tactics to force him to admit he made calls on Nancy Cooper's cell phone on July 12.

He also says police told him the Town of Cary was calling her homicide isolated "so people like you would be more comfortable."

"The police told me they had to investigate Brad because he was the husband," Hiller states in the document. "They also told me that if they were to arrest someone else without thoroughly investigating Brad, the lawyer for that arrested person would accuse them of doing poor police work."

Cary police had no comment on Hiller's affidavit, a town spokeswoman said.

In a phone interview with WRAL News Thursday morning, Hiller said he backs his statements but said he does believe Cary police are doing a good job with the case.

"We are just looking for justice for Nancy and the girls and for Brad, wherever the cards may fall," he said.

A man walking his dog found Nancy Cooper's body on July 14 in an undeveloped subdivision three miles from the Coopers' Lochmere home. An autopsy found she had been strangled.

Her parents, Garry and Donna Rentz, filed for custody of the couple's children two days later, claiming Brad Cooper is mentally unstable and poses a threat to the children.

Cooper was scheduled Thursday to give a deposition to the Rentzes' attorneys, who will be able to ask him anything that relates to his fitness as a parent, including whether he played a role in his wife's death.

Police have not named a suspect in the case, although there has been widespread speculation that he was involved. His attorneys have repeatedly denied that Cooper killed his wife.

Cooper must answer the questions or be held in contempt of court. He does have an option, however to invoke his Fifth Amendment right on any question that might incriminate him.

The Rentzes and Nancy Cooper's sister, Krista Lister, who has also filed for custody, will be deposed by Brad Cooper's attorneys next week. The temporary custody hearing is scheduled for the week of Oct. 13."

In an affidavit dated Oct. 9, Rosemary Zednick says she was walking her dog at about 7:10 a.m. on July 12 when she saw Nancy Cooper running along a bicycle path on Lochmere Drive toward Kildaire Farm Road.

Zednick says she made eye contact with Nancy Cooper and spoke with her.

"I said, 'Hi,' she turned her head and said 'Hi' back to me," Zednick said. "We were almost close enough to touch."

Brad Cooper, 35, is in the middle of a custody battle with his wife's family over the couple's two young daughters. Garry and Donna Rentz, Nancy Cooper's parents, allege he is an unfit parent and that he had been emotionally abusive to and financially controlling of his wife in the months before she was killed.

A friend reported Nancy Cooper missing after she failed to show up for a planned meeting, and a man walking his dog found her body two days later in an undeveloped subdivision three miles from the Coopers' Cary home.

Although police are not calling him a suspect or person of interest in the case, Brad Cooper has denied being involved in his wife's death. He said he last saw her on the morning of July 12 before she left for a jog.

His attorneys subpoenaed Cary police for all evidence relating to the murder case, including notes, personal property, physical evidence, computers and videos.

But Wake County Assistant District Attorney Howard Cummings said releasing that information could jeopardize the murder investigation.

Cummings called the request "a fishing expedition" in an attempt to prepare Brad Cooper's defense "to a potential criminal charge.""

She said she reported it to the CPD on three different occasions beginning the day after Nancy was reported missing. She has the business card of the detective she spoke with, and she left a telephone "statement." Read the affidavit, there's a lot more information than the article addresses.

all i am trying to illustrate is just because he got indicted doesn't mean he's guilty. but just because it took awhile doesn't mean he isn't guilty.

i don't even think a few months is that out of the ordinary for an indictment. and especially in potential spousal murder cases? i mean think about how much harder it is to collect evidence. what---you go looking for his finger prints in the house? OH WAIT, he lived there. his hair, prints, etc are probably everywhere. not exactly easy peasy lemon squeezy. plus there are other hurdles as well, i'm sure. i'm not saying that CPD didn't fuck up, i'm just saying it IS POSSIBLE that they didn't.

Indictments don't mean shit. if it took them this long to indict him, they don't have shit.


and honestly, the affidavit of the woman who said she told the police THREE TIMES that she saw her running the day she went missing is pretty damning for CPD - they ignored testimony to go on a witch hunt because they don't have any other leads.


That is the definition of complete ineptitude.

holllla just found a DOJ study on average length of indictment in spousal murder cases. 4 months.

granted it was the US DOJ
AND it was published in 1995 (so evidence from the 80s)
and it dealt with "large urban counties" --- and the 75 largest counties in the US. which i don't think Wake is (or maybe it is who really knows i didn't look that shit up).

but besides all the things that aren't relevant, it just shows things CAN take awhile.

but i'm just saying. this is not an episode of law and order people. we cannot have a murder, charge, indictment, conviction, sentence, appeal, RESULT all in 45 minutes.

i spent a large part of saturday listening to the story of a man who was wrongfully convicted and in prison for 18.5 years. i'd rather things go SLOW and be correct. not that going slow means they're anymore correct. but it is a little more reassuring i guess...maybe? well whatev...when you have a jury trial you're probably better off going with the the cuter lawyer over the qualified lawyer anyway.

i wonder how they'll pick jurors. hopefully they won't get anyone from this thread, its so polarized as it is. if any indication of the area at large then picking a jury will be hard.

personally, i still don't think it was him and i don't think this indictment means a thing. i think they just went ahead and did it because they were getting pressured due to the most recent hearing with his daughters/in-laws. someone probably told the CPD to shit or get off the pot.
