while it's obviously from the alcohol, the point is that the addition of caffeine significantly reduces a person's ability to judge their level of intoxication...while the combination of caffeine and alcohol quite likely does not present a risk chemically, it's physiological effects are inarguable...from page 17:

I understand your argument and it is valid. I just don't agree with the government stepping in for our 'well-being'. Obviously we got this far without dying or killing people while drinking Four Loko. This also applies to other banned products as well.

Come up with the science to prove it unsafe FDA.

my only "argument" is that caffeine's only purpose in this case is to mask the effects of alcohol and as such, is a stupid thing to do

I almost hope the FDA does aim for mixed caffeinated drinks now so that more funding will be put into studies that show they are safe. I talked to my distributor about this. I only know what will happen in the case of a FDA ban. But I do NOT know the circumstances around your NC state ban.

The FDA is giving the Four Malt Beverage companys, I'm guessing "Joose", "Four", "Max", etc... 15 days to make a counter argument. After 15 days, the FDA is going to make a ruling. After this ruling, they will give the companies 2 more weeks to sell to the DISTRIBUTOR. The DISTRIBUTOR has a deadline of 30 days after that (depending) to sell to VENDORS. VENDORS have 60 to 90 days after that to get SELL or GET RID of their inventory.

MillerCoors and Anheuseer-Busch were almost in the same situation. They were getting major pressure from the FDA, so they voluntarily recalled their product lines and submitted to a reformulation that the FDA had less problems with.
