- What police say is already suspect, as witnesses have come out to say that their statements were twisted and/or advised on what to say.
- None of the statements so far indicate how the altercation started. Would it be possible that Zimmerman initiated the altercation and got his ass kicked? Then he decided to shoot Martin once he realized he was in over his head?

Page 15-19 are a lot of my posts. Basically, if Zimmerman had the "right" of self defense, he lost it when he pursued Martin. Invocation of self defense has to be reasonable. So, even if you believe that you are in danger, it must be a reasonable belief. You also cannot be the one to escalate the altercation (i.e. by chasing someone, or by pulling out your gun and shooting someone in a fist fight). In all of this, self defense is an affirmative defense, which means that it is only relevant if someone is charged with a crime. In this case, Zimmerman should have been charged. Whether or not he was granted bail until his trial is a different topic. But he should have been at least charged (which I do think will come), and the investigation will pan this in a different direction.

There was a lot of talk about whether or not Zimmerman had the right to chase someone, and I argued that chasing someone fits the legal definition of assault. If Zimmerman is guilty of assault, which I think he was at the very least, then Martin would have been the one with the right of self defense, not Zimmerman.

I haven't personally seen whether or not there's enough evidence to convict this guy of murder, but I think there's definitely enough for manslaughter (which is what it would be if the jury found he thought he was acting in self-defense, but it wasn't reasonable). At this point, it needs to be kicked to the jury box, and not tried in the court of public opinion.

I did not say that. I said that using a gun in a fist fight is one example of escalation, I didn't say it was prohibited in every situation.

If you're getting the shit beat out of you to the extent that you *fear for your life*, or there's more than one attacker, then you can invoke self defense and shoot someone. If there's not fear for your life, then you can't escalate, just because you got punched in the face.

Self Defense also can't be invoked when you START the altercation, with few exceptions.

A fist fight implies that both people are standing and, while bodily harm may come your way... it isn't "great bodily harm"

The police report seemed to indicated that Zimmerman was on the ground... with a bleeding head and broken nose. That is not a fist fight. That is getting your ass kicked and could potentialy lead to great bodily harm... which IS a case where you can use deadly force.

We all know that Zimmerman was older and heavier than Martin. What seems to be neglected is that Zimmerman is a good 6" shorter than Martin, and most of Zimmerman's weight was likely fat. Where as we can reasonably assume Martin was in peak physical shape being a high school football player.

Interestingly enough. If Zimmerman's story is true, then Florida's stand your ground law wouldn't have even mattered. If Zimmerman had the "duty to retreat", you cannot retreat if you are on the ground getting beat up by someone whose on top of you.

I would have hoped that we all would have learned from the Duke Lacrosse thing.
