I have been selling cell phones for two years....and anyone will fucking tell you if the password is entered wrong too many times the blackberry security wipes and any data on it is history....deliberately scrambled to the point its not decipherable.

The whole point of Blackberry devices is they are ridiculously secure, corporations/govt agencies want to know if any employee drops their phone in the airport proprietary information is not going to be uncovered or leaked. If she actually did have a password on her device that only she knew there was likely no way to get to it to begin with....she took that information to the grave.

Still the detective was stupid for fucking with it if he did not know what he was doing, he created an issue out of something that could have been a non-issue in the trial. The defense is going to say she had some boyfriend or something that wanted to hurt her....and they never had a chance to examine her cell phone data to see who she was in contact with due to the detective causing the device to wipe.

They have an argument, cell carriers can provide some data regarding SMS text messages, but blackberry messages or other instant message clients that can run on a smartphone are not retained by the carrier.

I am not sure exactly what he did but it sounds like he entered the wrong PW, thats the only thing that could trigger an unwanted wipe.....the phone tells you how many tries you have left, it remembers even if it is rebooted, 10 tries is the most it can be set for, however the user can set it for less.

You get huge warnings on the last few that it is about to wipe.

I have had customers pretty much have a mental breakdown because their little kid got ahold of their blackberry and kept pressing buttons triggering the security wipe.

paraben makes a few forensic tools for the blackberry, they could have gotten something or at the very least taken a memory image to work off of so they didn't have to worry about wiping it. its secure to the lay person, but i'd bet the right person could have gotten the information off of it.

Exactly, if he had not caused the wipe he could have handed the device image over to the defense and they would have no way to claim he destroyed evidence....even if nothing could have been extracted from it they would not have destroyed it.

If I were on the jury I'd have to find Cooper not guilty just based on this cellphone bit alone. There is no way that someone is that fucking stupid. The device gives you multiple warnings and makes you jump through all sorts of hoops by DESIGN, and for him to casually neglect to mention that he had "accidentally" wiped the device in the search warrant really calls both his character and the prosecution's case into question.


If I were a higher up in the CPD, that detective would never work another shift in my department because he's either:

what gets me is that he got the information for the PUK code and how to operate it...then waited a WEEK to go through that process.

He didnt use any computer to dump the data, didnt send it to the FBI or even go to AT&T or the blackberry place thats right here in Raleigh.

All this and yet he still said today he had no idea what a SIM card is although he OWNS a blackberry and even knew the model number of it.

He intentionally did all that to the phone...he kept it in his desk for over a month, not in evidence and not in the electronics lab.


I hope Cooper sues the pants off of Cary PD.

According to what I heard today, Young called ATT Subpoena Compliance to ask them what he needed to get from ATT in order to unlock the phone. The ATT rep told him to ask for the PUK code along with some information about the phone. Young then had to get a court order with that request and send it to ATT.

The reason for the week delay was sending the paperwork for ATT and then waiting to get a response.

I think its a huge slip-up that Cary PD wiped the phone, for sure. But, during their investigation they had dozens or hundreds of things to check on, and they just decided to check out the phone in-house and it wasn't worth doing a more involved forensic analysis on, considering it wasn't one of their top 10 leads. CPD, along with any police department ha sa limited number of hours in the day and resources available. This wasn't one of their top priorities.

Websleuths is the biggest bunch of man-hating "it's for the children!" unhappy-with-their-own-lives old women I've ever seen. Well...most of them. Some people on there actually seem to have common sense, but they're few and far between.
