^^Problematically, pharmacists have even more ... discretion. They can refuse to fill a prescription if it violates their own moral code. Now, I'm in favor of private businesses being allowed to refuse service, but you would think that if you work for say, CVS, you would pretty much be required to fill a valid birth control prescription.. not the case.
Also, this dude chick sounds like a nut and should probably have his medical license reviewed and possibly revoked.

I think the argument goes that any law that discriminates against a class of people must be examined "heightened scrutiny" to justify that discrimination.

Prostitution doesnt just fall under "hey I can do whatever I want, victimless crime, just having fun, etc."
The state has a vested interest because of public health risks.
Gambling has demonstrable ties to organized crime, huge amounts of money, and addiction, etc.
Both probably have tax issues (or lack thereof) that the government is interested as well. You arent going to get out of them regulating both harshly. I seriously think you should all continue sticking it to the man, however. 3/14/2013 9:47:07 AM

I mean I think you have a point if you are trying to say that the Supreme Court has gained power over the last decade or two, but the 10th Amendment does not restrict the Supreme Court from hearing cases on state statutes.
