You can waive an implied warranty, but certain requirements must be met (like an "As is" clause). Even if its in the contract, if its not done the "right" way, its ignored. In NC, you can also "waive" the express exclusion of implied warranties by the course of trade/dealing/performance.

But the implied warranty or merchantability does not mean that the seller implies that the device you are buying will be perfect for all or even the specific act that you have in mind. Furthermore, what part of the bike was not fit for the purpose he described? Light trail riding and aparently getting to and from work. Even if it was medium trail riding, nothing indicates that the bike would not work, just that it isn't perfect for the job. Unless you are extremely specific in the exact thing that you want to do, a salesman will sell you something in between exactly what you want and not what you want, especialy because, as anyone who's worked sales can tell you, customers have no fucking clue what they want.
If I had to guess, I would guess that WaterGuy basicaly said something to the tune of "I'm looking for a mountain bike for some light to moderate trails that I ride and getting from point A to point B" If the salesman probed any further he probably was told that he'd be riding trails near some parks, and the sales man (perhaps rightly perhaps not) assumed that this would be on the lighter side of light to moderate. In such a case the bike sold was adequate (not great) for the purpose described. I honestly don't see anything wrong with how the actual sale and repair process went. You will always get sold what you asked for, if you aren't very specific, then you need to do your own research and as always "buyer beware". Remember in the end, what you buy is what you CHOOSE to buy.
That said, the response from Bikeman was highly unprofessional. Use of personal information beyond what Waterman had volunteered was inappropriate and bad business, and you deserve to be chewed out if not fired for it. It was entirely possible to present your side of the story in a professional and detached manner which would have allowed people to make their own decisions rather than make personal remarks and attacks which make you come across as an asshole.
Waterguy, something you might want to know for furture reference, when a service tech says "I know, I'd be pissed too, I'm sorry man but my hands are tied." it's a trained and canned response. It's designed to make you feel better about not getting your way by passing your anger to a faceless corporation as opposed to him. Barring very special circumstances service techs have a hell of a lot of leeway to make things better for you, if they're not then it's either a special circumstance or they believe it's user error. There's nothing wrong with the bike. It made a SOUND he didn't like. That has absolutely ZERO effect on it's intended purpose. Things make noises.
If he COULDNT ride it, then he MIGHT have a case. There's no way you are going to convince anyone, through any amount of legalese, that the sound of a shock bottoming out (which is what happens on ANY bike with shocks) is grounds for a refund.
