Yes and no. Having something without paying for it isn't necessarily stealing. Ever gotten a gift? Without setting out to deprive the restaurant of revenue, it's not 'stealing'. Dishonest? Most of the time, yes. But it's not a criminal activity.

Forgetting to add something is not intentional. Intentionally changing a customer's tip...guess what? Intentional.
I don't view it as stealing if I had nothing to do with the charge not appearing. The waitress created this theft. As a customer, if the waitress forgets to charge me for something, I've done nothing to make that happen.

If I'm not charged something, I figure it's on the waitperson, and tip as though it were included on my bill.

Nobody is 100% sure the waitress added the $3 on purpose. Maybe she did, maybe it was an accident.

And most restaurants require the managers to review the charge slips and the shit has to add up correctly in the computer before it will accept it. So most likely it wasn't even the waitresses fault, and one of the managers fucked up keying it in. And in that case, its just an accident, and not a theft since the manager doesn't make any money off it.

And I will be honest. If you knew, without a doubt, 100% that the waitress did that on purpose and was making it obvious she was stealing from you, then it would be ok to go down there. But for $3 when you don't know what the fuck happened....just let it go man. If it had been $50 or something, then by all means go down there no matter the situation. But to go through all this over $3 is just ridiculous.

Given that a $7 is one digit, and a $10 tip is two...I'm not believing $10 was keyed in by accident.
And $7 doesn't look like $10.

You'd be amazed at how bad some peoples handwritting is. And like I said, even if she did key it in wrong, management should have caught it. The tips don't get sent to the CC company till the end of the night after they have been reviewed. So going by this, its almost for sure just an accident.

Either way, its $3, shit happens in life all the time that isn't fair, just suck it up and move on.

A waitress should never give herself a tip. That's just ass. And Ambrosia is right, $7 does NOT look like $10.

You should find her and offer her the $3 if she lets you kick her in the vagina. If she's willing to steal, maybe she'll be willing to earn it back.

It's most likely one of three things:

1 - Waitress/bartender/manager misread your 5 as an 8 (when you're adding up tons of stuff at the end of the night you don't always get everything right

2 - Miskeyed the 5 as an 8. on any keypad or credit card machine the 8 is located directly above the 5, easy mistake to make.

3 - They fucking stole your money on purpose.

You should hope it's either 1 of 2 and you can chalk it up to human error or sloppy handwriting. But, it is a bar (even though I know the owners) and there are always shady fuckers working at bars.

All you "it happened because you're a shitty tipper" folks should go jump off a fucking bridge.

i'm not reading 3 pages on this shit

but does anyone else here think it might've been a typo? i mean, the 8 is right above the 5 if they were keying it in to a computer or register. i still think you should call your CC company, but look at it this way - if the server was going to risk their job/possible legal action by scamming you, don't you think they'd have at least tried to make it enough to buy a full gallon of gas?

^^This happens a lot actually, even the food service people in this thread admitted it. They probably didn't do a large amount so it wouldn't be detectable as easy. They were probably assuming the person wouldn't check, wouldn't remember because they were drunk, or just wouldn't give a shit about a few bucks.

This isn't the same thing. In your example it's the restaurant's fault they didn't charge you for the drink, not yours. How is that comparable to a waiter/waitress scamming you by adding in extra tip? A comparable example would be you erasing the drink from the bill before paying at the register.

Gotta love the self fulfilled prophecies in the tip giving department as well. Wait staff thinks to self "They aren't going to tip well, so I'm not going to give decent service." Customers leave lousy tip that reflects service given. Wait staff says to self "HA! See... I knew it!"

Service comes before the tip... in most places I've been. But I guess all wait staff everywhere has a photographic memory and could recognize a city's worth of people from years past. Either that all wait staff everywhere share some kind of collective conscience.

called yesterday and the manager told me to come in today some time after 2

showed up at ~2:20 and asked for the manager. I had to explain the situation again to the bartender, but the manager came out within about 5 minutes.

apparently the manager that I talked to before wasn't there (even though he said he would be), but the manager that was there knew the story and just gave me $3 out of the register

they didn't get the charge slip, so I couldn't see if the waitress messed with the tip line or it was just a miskeyed entry, but I got what I was owed so I didn't see the need to press the issue

if I go back there you can be sure I'm going to either pay cash or watch my receipts incredibly closely

I've had some pretty pissy wait staff before, I'd be willing to bet they were mad at your tip and changed the 5 to an 8, it'd be pretty easy to do.

I would hate that. Every 10-15 minutes would be too much bothering to me. The waitress just needs to come by whenever drinks are getting low (not empty yet) or the food it not being eaten anymore. Check the table after food has been brought (atleast after 5 minutes) and then leave me alone.

In my opinion good service is walking by atleast every 5-10 minutes without saying anything giving the people at the table to opportunity to ask for something. As you walk by check on their drinks and whatnot. Every 20 minutes or so, probably longer, walk up to the table and ask them if there is anything they need.

There are two things that annoy the piss out of me. Sitting at my table trying to get a new beer or put in another food order and the waiter(ress) in no where is the first. The other is a waiter(ress) that comes up every 5 minutes and interrupts you to ask if there is anything you need.

Don't do those two things and I'll tip 30%+ on a small bill and 20%+ on a large bill.

And if I find out you changed my credit card receipt to add more of a tip I'll be damned if I don't file a report with the police.

Thats not what I was saying. I said if the table is known to be bad tippers. When I used to wait tables, you would get fantastic service the first time I waited on you, if you tipped me bad, then I usually would remember you, and the next time you came in, you got what you wanted, but I would not go out of my way to take care of you if some of my regulars were in there that I knew tipped well. I just never assumed a table would tip bad and then give just mediocre service, I always gave them great service the first time, and as I said, if they left a bad tip, THEN, the next time they came in I took care of them as well as they tipped me before.

you tip for SERVICE. you don't get served based on a tip. notice how one follows the other?

My tips range from 0-45% depending entirely on service. you suck, your tip sucks. youre great, your tip's great. see how that works?

If anyone ever added money to a CC bill, i don't care if its a dime, i'd cal lthat place up to bitch and follow it up w/ the CC company if need be. i don't see how you losers can justify blatently stealing.

I used to wait tables, if I got stiffed I'd get pissed but that doesn't entitle me to steal. If I was super busy and only came by every 30 minutes --which is not possible if you are half way decent at your job(I would expect a shitty tip, I would not expect to get 20% just b/c I am busy and I want you to feel sorry for me)

There are plenty jobs where you get busy and can't provide quality service, waiting tables is no different. If you got left shitty tips all the time people wouldn't wait tables.

I was over charged at stool pigeons once a few years back. Even if it isn't a lot of money you should fight it if you are up to it or the server will keep on doing it.
