Aren't the crips considered a criminal conspiracy? Under the more prosecution-friendly federal anti-conspiracy laws, as upheld by United States v. Shabani and United States v. Monroe, people don't need to even know the members of the conspiracy that actually commit a crime or even make overt steps towards commission of relevant crimes themselves. Granted, federal anti-conspiracy laws are usually brought against more traditionally organized crime like the mafia; still, it seems that the crips, bloods, and latin kings all constitute criminal conspiracies that cross state lines. It seems that since those gangs are fairly clearly conspiracies that cross state lines that membership in them would constitute being guilty of criminal conspiracy to extortion, murder, drug trafficking, etc. Wouldn't advertising membership in one of those conspiracies, such as the not-so-subtle references on his facebook page, be at least partial grounds for a warrant? As frighteningly big-brother as it sounds, wouldn't it behoove our campus police or at least Raleigh police to go through publicly available facebook profiles and look for blatant signs of gang membership? Sure some might say it sounds like a fishing expedition, but those profiles are only made and made public at the consent of the user. The constitution does not protect against the idiocy of someone doing the equivalent of announcing their crimes in the classified section of a paper.

hahahaha, this stupid son of a bitch wishes he was big-time enough to be considered a conspiracy
7/29/2008 7:05:18 PM
but it does protect against the lack of probable cause when carrying out a warrantjust becuase someone claims to be in a group doesn't mean that they are, nor does their simple affiliation with any particular group imply automatic criminal activityyou need look no further than mainstream rappers who proclaim alliegiances to the mobI'd much prefer it if my tax dollars werent wasted by policemen sitting on facebook looking for gang members, when they could be out doing real police work to catch gang members who have committed crimesbecause arresting someone just because they claim to be/are a crip without any other stipulation of a crime being done is a good and quick way to get your case thrown out of court

just label them terrorists and then you can impound whoever you want[Edited on July 29, 2008 at 7:10 PM. Reason : +]

7/29/2008 7:11:57 PM
he'll just be released as an even harder criminal and more of a threat to society

^^^^^ So if someone went around claiming to have shot someone, should they not expect to be arrested. Should someone who advertises that they make and sell meth expect police to ignore it because they might be making it up?This is an organization that is guilty of many violent felonies. It seems reasonable that claiming membership in it, or any similar criminal conspiracy, should not be taken lightly. This is similar to the idea that anyone claiming to have a bomb on an airplane should expect to be tasered/maced/shot.Obviously people do make these claims without repercussions. Just as with other crimes though, this should not automatically be the case. Do note that I did not say complete grounds for a warrant, but "at least partial." The claim would have to appear credible and be somewhat corroborated, but with search functions on facebook available it seems that it would be worth a few hours of a police officer's time to check out. Also, I did intend to imply arresting someone because of claimed membership, but actual. As these gangs are criminal conspiracies, the membership would have to be proven in some way. Links to active and convicted members would most likely be required. [Edited on July 29, 2008 at 7:18 PM. Reason : ]

I agree with everything Charybdisjim has said. Whether you're joking or not about being in a gang, that shit should not be taken lightly and warrants at least a closer look in each case.

I'm wondering why the fuck this kid was in a gang if his grades and SAT scores were good enough to get into college. Seems like a gang would be counterproductive.
