Basically the same amount of crime will happen not matter what laws are in effect, it just laws spread out the instances of crimes.

You are indeed an idiot. Well, I won't go that far, I will say you can't articulate at all what you are trying to convey. Twice now, you are implying with the language you are using that the death penalty isn't serving much of a deterrence. And in this case, we'll let "much" assume no deterrent, because that is certainly what you are implying. You just restated again that murders still happen so the penalty isn't a deterrent, then you won't to cry to me that it probably does, but you'll only say it doesn't have a "huge" effect, whatever that means?
