Attorney: Spring High teacher accused of sex assault is innocent

SPRING, Texas—A Spring High School biology teacher accused of having sex with a 16-year-old student appeared in court Wednesday for a probable cause hearing.

Prosecutor Denise Oncken said the teen first told authorities about the alleged incidents when he was called in for questioning.

“He told the officer about what had occurred in several instances with the teacher involving sexual assault,” Oncken said.

Court records indicate the father of Higgins’ children, whom she was divorcing at the time, first learned about the alleged incidents after finding text messages from the student on Higgins’ cell phone.

The teacher had given the phone to her son before a weekend visitation with his father.

“There were some sexual innuendos in the text messages,” Oncken said.

Court records indicate the student told police Higgins left a pair of panties in his truck after one of the alleged incidents, which the teen turned over to investigators.

Oncken said prosecutors will conduct DNA testing as part of their investigation, but she didn’t say what items were to be tested.

Meanwhile, defense attorney Troy McKinney said his client was “dramatically” affected by the allegations against her.

“As you can imagine, anybody that’s accused of this type of crime, her life is turned upside down. She no longer works for the school district. She’s been put on leave for the time being. Her friends and her family now look at her in a different way,” McKinney said.

McKinney said Spring ISD indicated they were going to talk with his client before filing charges, but they did not.

“Our position at this point is we regret that Spring ISD decided to jump the gun on this and file the charges without conducting a complete investigation. They have not done so,” McKinney said.

He believes that ultimately, Higgins will be exonerated.

Spring ISD officials sent a letter home to parents on Tuesday saying the DA accepted the charges against Higgins the day before.

“The Spring High School Administration and Spring ISD Police Department immediately began investigating the allegation after receiving a report from a third party,” the letter said.

District officials said Higgins resigned when the allegations first surfaced in September. She was hired at Spring High School in January 2008.

Some students told 11 News they weren’t surprised by the allegations.

“Actually, lots of people saw this coming,” Spring High student Brooke Caravela said. “She was, like, very open, so it just seemed like she would do something like that. I think teachers need to get their heads screwed on straight – that’s not right.”

Others expressed shock that the teacher they knew could be accused of something so serious.

“It was surprising because she was like a sweet, nice teacher,” student Devonddrick Pipkins said.

And Higgins isn’t the only teacher under investigation in the district.

Tuesday’s letter to parents said a second teacher has also been placed on paid administrative leave while a separate investigation is conducted.

“You may have heard rumors that another Spring High School teacher has been placed on paid administrative leave. It is true that a second teacher is on paid administrative leave while an investigation into a separate issue is in progress,” the letter said.

No other details on that investigation have been released.

Spring ISD issued the following statement late Tuesday: “Incidents involving improper relationships between teachers and students are not tolerated in Spring ISD. We have made it our practice to take allegations of this nature seriously. We will investigate thoroughly any report we receive and pursue criminal charges when appropriate.”

The Daily News now reports that a third teacher at Brooklyn's James Madison High School is under investigation for illicit sexual activity, albeit unrelated to the alleged naked classroom romp.

According to the News, Allison Musacchio, a social studies teacher, is being investigated for having an inappropriate relationship with a male student after a female student "saw her ex-boyfriend's phone number on the tenured teacher's cell phone."

This is the second sex scandal to hit the school in as many days.

On Wednesday it was reported that teachers Alini Brito and Cindy Mauro were caught naked in an empty classroom by a janitor. The janitor, believing the two were students, reported his discovery to school officials.

School officials released a statement that the two teachers have since been reassigned "pending the outcome of the investigation."

What a STUPID STUPID argument. The punishment she got was reasonable. The male punishments are ridiculous. We need to bring the male punishments back down to earth and set them equal to the women's punishments...you know... if it should even be punished at all.

It's not even a rape and the judge said it's consensual! I fail to see the crime.
