This is utterly absurd. How could you possibly think a bystander is an accessory to the crime by not acting. There's no duty to act to save someone else (unless a special relationship exists, but that's not this case). There's no duty to put yourself in danger for someone else. If some crazy dude is swinging a metal rod around, I'm not jumping in to save 2 strangers, or I'd be sitting there with a cracked skull and broken bones too, and what good does that do?

^^^correct.

in many cases you can be charged with a crime if you use force to break up a fight between two other people where you have insufficient knowledge of the situation.

Hero = person who halts a man from defending himself against TWO clearly violent aggressors?

And risk appearing as an aggressor yourself? Cost-benefit analysis says "No thank you".

You absolutely can't be found guilty for failure to act (like I stated above). The only conceivable way a person can be compelled to act is if there was some kind of relationship (a father has to protect his child if possible, a lifeguard has to attempt to protect a drowning swimmer, and someone who causes the injury cannot leave the victim without helping). Alternatively, you can be compelled to act if you were a member of the conspiracy, and did nothing to stop it.

However, none of those situations apply here. THERE IS NO DUTY TO ACT IN NORTH CAROLINA, whether it's under tort law, or criminal law. And the Good Samaritan law you quoted, also doesn't apply in all situations here. If you start to help someone, and you screw it up, you could be liable. If you start to help someone, and then negligently stop, you could be liable.

End result, don't butt in. Save your own ass.

^those laws are for injured/ill persons. they are not about breaking up fights/stopping violence/etc.

two completely different things

^That was my point. The good samaritan laws have nothing to do with stopping a crime in action, but with negligence, and so isn't even relevant to this thread. Two different realms of law. My bottom line is that there's no duty to act in either realm, and you're best off to not get involved, from a legal perspective.

I've saved several people's lives not because I am 'super awesome' but because I hold myself responsible for others' well being if it is in fact within my ability.
People that disagree with my sentiments are why the planes were taken over by terrorists with simple box cutters on 911...I'm not here to judge, we all make our own choices in life. Good men failing to act is a terrible thing.
No, there's no law saying you must act proactively to save someone, but that employee in particular was out of control and once the two women were down he kept at it with a gleam in his eye and should be charged with a crime - he went beyond self defense and methodically continued inflicting damage against people he had just rendered helpless...simple assault doesn't justify those two women...someone's sister, mother, daughter, girlfriend, etc. getting bludgeoned to the point it went to.

I.E. - someone who failed them somewhere along the lines in terms of instilling them with a sense of duty.

Because it is certainly a tragedy for family members to hear their kin was not properly raised to the standards of society, and thus faced the consequences for their outlandish behavior later on down the line.

Perhaps had these puppies been spanked earlier on, behavior like this would have never been seen. But I suppose "nipping it in the bud" would require too much responsibility for one to undertake.

Not to mention

1) The hijackers told the passengers they were going back to the airport and that everything was going to be okay if they didn't do anything.

2) The hijackers told the passengers there was a bomb on the plane.

3) Prior to 9/11, people were told to cooperate with terrorists and avoid being an opportunistic hero for fear of messing up and killing everyone.

No. I've stopped violent situations by means of violence a few times myself, but I wouldn't have dOne anything here, because I don't think he did anything wrong. They had it coming, and he responded pretty appropriately.

we have an ex con who served his time and debt to society, and then got out and got a regular job. He was just punchin' the clock trying to support himself, pay taxes, and maybe make a little fun money for Halloween and Christmas.

NO ONE should fault him for fighting back after he got slapped or bringing the hammer when they pursued him into the kitchen.

"So-called McHero Rayon McIntosh -- busted in the violent, caught-on-video beat-down of two women customers who'd jumped the counter at his West Village McDonalds -- may have a self-defense case, but that'll be up for a jury to decide, a judge ruled today in ordering he remain held in lieu of $40,000 bail.

The decision, by Manhattan Criminal Court Justice Gerald Lebovitz, followed a court hearing in which prosecutors argued successfully that video and eyewitness accounts support felony assault charges against the alleged fast food fiend.

"The defendant had no reason to strike [customer Denise Darbeau, 24, of Queens] on the back when she was face down," argued assistant district attorney Jamie Hickey Mendoza. "That action by the defendant was not reasonable," he said, noting that Darbeau suffered a skull fracture.

McIntosh sat glumly at the defense table as his defense lawyer, Theodore Herlich, countered that his client acted reasonably, out of concern for Darbeau and the second woman, Rachel Edwards, 24, of Brooklyn.

"Were they going to take grease from the French frying machine and throw it in the defendant's face?" Herlich asked the judge. "Who knows what they were going to do."

The angry women hurdled the counter after a dispute over another cashier insisting on scrutinizing, and ultimately accepting, a $50 bill, one eyewitness told the judge during an hour-long hearing on whether McIntosh could be held despite prosecutors not yet winning a grand jury indictment in the case.

Cell phone video of the brutal beat-down went viral on YouTube, and prompted several Facebook cyber-support pages for McIntosh."
