On re-cross (after re-direct), Kurtz had Krista read an excerpt from the previously-mentioned custody hearing, where she said that Nancy was given $700 and she spent it all on groceries for everyone at the vacation (all 14 people) and gas to get there.


So, she went from "I don't recall saying that and I don't recall any specific dollar amount" to reading her own words to the court, where she said it.


This also goes against the idea that Nancy wasn't given her $300 for the week...she was given $700 for the week prior, and she blew it all on groceries (and who knows what else?) for everyone else while Brad was back home working 16-hour days at Cisco while she was on vacation.

The judge is allowing it through some loophole -- it isn't be admitted "for the truth of the matter" but rather "to show Nancy's state of mind at the time".


With everyone testifying to how Nancy constantly bad-mouthed her husband, I don't think that puts her "state of mind at the time" in a very good light.
