Im pretty sure the reason why laws exist in this country is that they were passed by an elected legislative body and were not deemed unconstitutional by the supreme court

nice strawman. That was NOT my position.
HERE IS MY POSITION: Morality says what is "right" and what is "wrong" Laws say what is allowed and what is not allowed. What is allowed and what is not allowed is analogous to "right" and "wrong" Laws are equivalent to morality.
Quote : | "so if a law were passed tomorrow making it illegal to smile, anyone who smiled anyways would be doing an immoral act?" |
it depends on what you mean by "immoral act." If you mean "an act that is considered wrong by the standards set forth by that society," then yes, it is "immoral." If, however, you mean "something truly reprehensible," then, no, of course not...

how is that a problem?
A law says "you shall not murder someone." To me, that says "this society says that murdering someone is wrong." Clearly our code of laws is a "system," per the secondary definition of morality...
what is the difference? where is the dividing line between laws and morality? You have yet to say this very thing, which is the crux of the issue. All you've said is the typical elitist "oh, you just don't understand..."

Dude, your argument sucks. Law is not morality. I'm sure there's some brilliant theory that says otherwise, and we can learn a lot from those theories...but they're just exercises in different ways of thinking about the world--they're not practical, and they're not reality. 6/30/2006 5:55:53 PM |

Kohlberg's Stages of Morality
You can read about it here: http://students.usm.maine.edu/bmcpha61/Kohlberg_stages_of_morality.htm
See, doofus, you're at stage four, maybe stage five. You'll probably never get to stage six. Few people do.

it does suggest the notion of a social contract. Laws are made by societies... don't break the law, and you keep your rights. sounds like a contract to me...
Quote : | "The point was that I needed to make a law to make Rush's premarital sex immoral" |
Something can be reflective of a morality without being "immoral." Morality isn't just about "wrong." By your logic, Christianity doesn't have any standards of morality because you would need to add to it in order to make eating biscuits immoral. In fact, and I'm about to blow your mind here, morality actually covers more than just "right" and "wrong." It also covers "not wrong." And no, "not wrong" is not equivalent to "right."
