If you hit your head hard enough to crack the helmet, the helmet was probably working just fine. Helmets aren't made out of indestructable kryptonite.

^^ Um no, helmets are made to protect your head and one cracking shows a defect in the helmet itself. All helmets are inspected every year for this very reason. I have the 04 Inspection sticker in the helmet along with the crack.

no, they are inspected so you don't play with one that's cracked you moron, it's on you to report a crack to your equipment guy to get a replacement dumbass.

anyways, if you even attempt a lawsuit like this (and no one will take this that's legitimate) you will get laughed out of court.

on a side note they need to make the loser always pay the court costs

No as soon as it cracked I swapped it for a new one and got to keep the broken one.

However a helmet cracking after being cleared by the committee for 2004 (my Sr year) should be their fault for passing a faulty helmet.

Football helmets don't just crack and I still don't think the two retards above understand the difference between a motorcycle helmet (which is made to break in a wreck) to a football helmet that is constantly in "wrecks". Football helmets are certainly not made to crack.

Well if it happened in 2004 and you wanted to have a personal injury claim, the statute of limitations is 3 years in the state of NC... (Not completely sure if this would count as personal injury, but just fyi you might be sol)

^ I'm pretty sure almost every attorney in situations like this doesn't have a fee unless you win.

you would still be responsible for the costs of litigation...obtaining experts, any medical records of yours they would request, depositions, mediation, the filing of a lawsuit, costs of exhibits etc.

expert testimony alone can be very expensive.

that's how contingency works...they front the costs & recoup those costs regardless, and if you win they get their fee out of the total win.


only if they took your case pro bono would you not have to pay anything.

Well the main thing I could sue in my own opinion is the helmet and/or pad manufacturer. Because when all the pads are in the helmet (not like in the picture, the air system is missing); you can't see the warning label. This combined with coaches constantly saying "head in the numbers" over and over gives me chance of winning, not say I will, but it's better than suing McDonalds for burning your self with coffee (because we all know coffee is cold normally when served).

^ The lady who burned herself with coffee had the cup practically thrown at her from the drive-thru window and received burns (second and third degree I believe) on her groin. She was about 70 years old and had to have skin grafts, etc, around that area. Don't even act like your case is better than that one.

I like how you're changing your tune from initially just suing the coaches to now suing the helmet maker. And yes, attorneys don't charge a fee unless you win (called a contingency fee), but they also don't want to waste their time on a frivolous lawsuit (which is what you have). They want to spend their time on stuff that actually makes money.

And here are the facts about the McDonalds case:

- A majority of places that sell coffee keep their coffee at 135 to 140 degrees. McDonalds kept their coffee at 190 degrees. It wasn't hot...it was scalding. McDonalds said that most people got coffee at the drive-thru and didn't drink it til they got to work or back home, so they wanted it to still be hot when they got there. They knew that it was too hot to drink, but said they weren't concerned about minor burns in the mouth and tongue when the majority of the people would like the fact that their coffee was still hot 15 minutes later. Studies show that if they reduced their coffee temperature to just 155 degrees, that the risk of burn would decrease exponentially. However, McDonalds REQUIRED their restaurants to keep their coffee around 185 degrees.

- Between the years of 1982 and 1992, there had been 700 claims of people being burned by McDonalds coffee...many of them 3rd degree burns.

- The lady who filed suit, suffered 3rd degree burns to over 6% of her body (inner thighs, buttocks, and genital and groin areas). She was hospitalized for eight days, during which time sheunderwent skin grafting.

- She offered to settle for $20,000 just to re-coup medical costs...but McDonalds refused. It was a jury that awarded her the large lawsuit (although they later settled out of court).



That woman got her vagina burned because of willful and reckless conduct of McDonalds...and that's why she awarded punitive damages. You have a sore neck and diminished brain capacity because you played a rough sport in high school. Please continue to waste your time on this.

Not really. She had it between her legs and took the top off to put cream and sugar in. But she won because of how hot McDonald's keep their coffee. Her negligence in the situation wasn't really a big obstacle.

He's not going to be able to find an attorney dumb enough to take this case. The rich attorney's that can afford to waste time on a contingency case like this are too smart to do it. The ones that are dumb enough to take it, are too broke to take a case that will waste this much of their time and are only taking stuff that requires retainers up front.
