I'd expect something along the lines of McD's hiring "dangerous" employees or having an environment condusive to this type of behavior. Some bullshit that will make McD's have responsibility in this matter. Not that I believe this bs, but I know how lawyers think. 10/18/2011 10:58:11 PM |

It would be interesting to see how this is argued in court. Other people were obviously, at some point, trying to get him to restrain himself, but we also don't see what's happening behind the counter. It's possible that they were moving, trying to get up, and appeared threatening in some way. It would not be an easy defense, but I imagine it will be argued.
Plus, in a jury trial, there's no telling. There never is. They could see him as a hero just like the public and much of the media has. It only takes one.

so hypothetically if someone were there who had a conceal & carry license would he get in trouble for shooting that mother fucker?
(or at least firing off a warning shot?) 10/19/2011 12:19:43 PM |

I don't think you can concealed carry in NYC.
If the same thing happened in NC you would be charged with manslaughter. If Person A (the two girls) instigates the fight and Person B escalates it (the guy with the rod) you will be charged with manslaughter if you shoot Person B to stop him from doing further injury or killing Person A.

First off you can't fire a warning shot (if you take out your gun other than to shoot someone, you will be charged). You might also be charged for intervening, but it is something that you will more than likely be exonerated on- there will be a lot of legal tape but a competent lawyer could make a great defense. 10/19/2011 1:04:24 PM |

^ Just stating how it works here since sumfoo1 asked.
You have to be very careful before defending another person. Even though they may be in grave danger you can go to jail if it can be proven that they instigated the incident that put them in that danger.

^^ even pulling out your gun and saying you could shoot can be considered threatening. The way the law goes you can only take out your gun to use it. Granted if it went in front of a jury, it would more than likely be dropped, but as it is now, it would be considered brandishing a weapon 10/19/2011 4:28:51 PM |

All of this bystander with a gun shooting blanks warning shot nonsense is just asinine. If you pull a firearm you had better be ready to use it to end a life and you have significantly escalated the situation. Unless your life is being directly threatened you will most likely get some kind of charges thrown at you.

I believe in North Carolina and probably most other places, if you discharge your weapon for any reason it's considered use of deadly force. Even if you deliberately fire into the ground according to the law you are using deadly force, so you better have a damn good reason for what you did.10/19/2011 8:32:36 PM |

no, you cannot fire a warning shot, blank or not. you'd be charged with discharge of a firearm within city limits (or whatever they call it) at the minimum. the only exception is in the course of self defense (and that depends on city/state law; no city in nc prohibits discharging a firearm for self defense).
as for this particular case, as a third party, you could very likely be charged for coming to the defense of this man. i sure as heck wouldn't pull my firearm to defend him. the laws surrounding this are open to interpretation and a bit mucky.
safest thing to do is never defend a 3rd party... unless:
- it is family - you know ALL of the details leading up to the situation (highly unlikely) - you reasonably believe the attacker is intent on death or serious bodily injury - deadly force is the only force capable of stopping the threat.
let's say you have a son, who earlier in the day was experiencing road rage and flipped off/cursed at another driver, etc. then you and your son meet at mcdonald's, a few minutes after the incident. while you're in the bathroom, the victim of the road rage comes in, you walk out of the bathroom, see the person start attacking your son, you pull your weapon and fire at the person.
it's your family and all you saw was some stranger come up to your son and start beating him. theoretically, you could be charged since you fired upon the original victim and your son was the instigator (legally, you cannot defend the instigator).

if the guy had stopped swinging when he had them on the ground, he would get out of this PRACTICALLY scott free. The only thing his defense would have to be would be, "They were wearing baggy clothing, it was in my belief that they could have had a weapon that would have fatally harmed me, so i protected my life and my co-workers life to the best of my ability."
HOWEVER.......since he continued to beat the ever living shiat out of them, that defense gets blown out the window and his charges will probably stand. 11/8/2011 3:25:17 PM |

Quote : | "Kailua resident Kollin Elderts bled to death after being shot once in the chest, a wound that also injured a lung, the city Department of the Medical Examiner said Monday.
Details of the violent conflict that took Elderts' life Saturday morning remained sketchy on the eve of the Asia-Pacific Economic Cooperation summit, where Special Agent Christopher Deedy was to help provide security as leaders of 21 nations gather in Honolulu this week.
Deedy, who is charged with shooting Elderts at Waikiki's Kuhio Avenue McDonald's early Saturday morning, was released from police custody after posting $250,000 bail at about 4:30 a.m. Monday. He is scheduled to make his initial District Court appearance on Nov. 17 after being charged Sunday night with second-degree murder and the use of a firearm in the commission of a felony.
Police said Deedy, 27, shot and killed Elderts, 23, during a confrontation at the 24-hour McDonald's at about 2:44 a.m. Saturday.
The city Department of the Medical Examiner said that Elderts died of "exsanguination due to a gunshot wound to the chest with an injury to the lung." Coroners classified the manner of death as a homicide.
Deedy is an employee with the State Department's Bureau of Diplomatic Security, and has been placed on paid administrative leave.
Except for stating that an altercation among four men led to one man being shot dead with a single bullet, authorities have released no information about the circumstances surrounding the incident.
According to a source who wished to remain anonymous, two bullets were found in the ceiling and the wall of the McDonald's.
The source also told the Star-Advertiser that a pocketknife was recovered at the scene, but it is unknown to whom it belonged. The knife had blood on it, but no one was reported stabbed, the source said.
Additionally, the source said Deedy refused to take a blood alcohol test at the scene and that he appeared to have been drinking.
Michael Green, attorney for Elderts' family, said he did not believe the knife belonged to Elderts, based on information he has received from a friend of Elderts who was also at the McDonald's.
However, Green said, the altercation between Deedy and Elderts began and ended at McDonald's. Green had previously said the altercation began at a nightclub. Green said that initial story was an assumption Elderts' family had made.
Green said the Kalaheo High School graduate's best friend has given a statement to police and has told him that he and Elderts caught a cab to Waikiki late Friday after dinner with friends at SoHo Mixed Media Bar.
The friend said he and Elderts were briefly at a Waikiki karaoke club before going to the McDonald's, according to Green. While in the front of the line for food, Elderts was joking with employees behind the restaurant counter and noticed three men and a woman in the adjacent line looking serious, the friend told Green.
"There was a discussion between Kollin and that group, saying, 'How come you guys are not happy? Everybody's having a great time in here.' And then they had words exchanged," Green said. When Deedy threatened to shoot Elderts, Elderts invited him to do so, according to Green.
Green said the friend witnessed Deedy "karate kick" Elderts, dropping the younger man to the ground.
"Our client gets up, smacks the guy ... (there is) grappling ... and three shots go off," Green said.
A FEDERAL LAW enacted in 2004 allows qualified law enforcement officers to carry concealed weapons while off duty anywhere in the United States.
Among the qualifications is that the officer cannot be under the influence of alcohol or any intoxicating drug.
Alan Gano, a retired criminal investigator with U.S. Customs, said policies for federal agencies he's familiar with prohibit law enforcement officers from carrying weapons if they were drinking alcohol." |

Exactly. If a male attacker had just slapped a female cashier, then the male would be up for a prison sentence and the female cashier would get a full hour on Oprah.
The female cashier could have calmly walked around the counter after being slapped, pulled out a glock-9, and gunned down the guy who slapped her. She'd be heralded as a feminist freedom fighter and the man would have "gotten what so many abusive men deserve."
The girls took a severe beating, but in my opinion, it's warranted.
