he's actually thought through the constitutional and legal aspects of this quite a bit. and he's right. like most states, Ohio has written in their legal code that if you're not driving a car, you dont have to present any formal identification to an officer. unless you're being arrested, then its a moot point. .

Those in gov't authority positions granted with power to use deadly force should have a pretty expert knowledge on the law.

now that i actually read the guy's explanation of what he was doing, it's clear to me that he wasnt just a douchebag looking to cause trouble.

I don't disagree with what he did. I think he has a valid point that people should understand (that most people won't thanks to the media, unless they read his blog).

but you see, he wasnt necessarily calling the police to "help" him. he was calling them because he was being illegally detained by a private security team, and it was his only recourse.
when the police arrived, rather than assessing the situation according to the law (which says that non-membership stores can not detain customers against their will)... the cop treated him like a suspect by demanding his drivers license (which is unlawful, according to state law), then arresting him for, essentially, being an advocate for his Constitutional right (Fourth Amendment) to be protected from unnecessary search and seizure.
on the one hand it seems kind of douchey to talk about this in the context of Circuit City receipt checkers, but really, these are fundamental rights being eroded in favor of an overreaching (and increasingly militarized) police state.9/22/2007 1:38:50 AM |

So how does this fit in with the airlines illegally detaining passengers for 10+ hours in an airplane? That still seems to be okay for some reason.
