They haven't fined him yet?! Because they feel bad for him?!

He had a drainage problem when he bought the house, and the town has offered to fix it and he has refused?!

Ugh, this story reeks. I don't pity the guy anymore.

The amount he's asking for is about $130 a square foot. Which is like $30 more a square foot than comps.

this is stupid. he had the issues when he bought the house...and it doesn't sound like he takes care of the property, and the city has offered to install grate/pipes, to which he refused.

An important thing that has been left out of the discussion is the buyers responsibility to anticipate changes around a property they buy. Maynard road loops around the entire town of Cary, even the smallest amount of prudence would have made him think that the scenery in front of his house could change over time.

What they did to his house seriously devalued it but that is also one of the risks in owning a property. You are married to it whether it goes up or down in value.

If you read Frantz's blog entry:

http://donfrantz.blogspot.com/2009/08/red-letter-house.html

There's a handful of very interesting facts... The trees in the gutters aren't the most interesting part, I'd say this:
Quote :
"Mr. Bowden has refused to allow Town of Cary employees on his property to construct the drain, and instead is demanding that the town buy his house for $170,000 and pay him $80,000 for his “troubles”."

Paired with:
Quote :
"Looking back at my meeting with Mr. Bowden what I find most interesting now was a more casual discussion we had in which he spoke about his online ‘friend’ and his quest to buy a Dodge Viper."

Interestingly enough, $80k would get a person most of the way there on purchasing oneself a brand new Dodge Viper.

I'm truly shocked that Cary hasn't actually charged him with any fines until today.

http://www.wral.com/news/local/story/6405787/

Quote :
"
Cary again asks man to remove sign

Cary, N.C. — A Cary man could face a fine for the spray-painted protest he has on his Maynard Road house.

The town issued a notice Thursday against David Bowden, noting that his message – with words that some might find offensive – violates size and color limits set by the town’s sign ordinance.

Town staff first visited Bowden to ask him to change the sign in July. The violation, which allows for fines for each day the message remains on his house, has yet to be enforced.

Officials decided to proceed with enforcement because of continued complaints from the community and a lack of progress in negotiations with Bowden, the town said in a statement.

In a letter hand-delivered to Bowden Thursday, the town outlines the stalemate and asks that Bowden “support your community’s sign rules and take the required corrective action to remove the sign currently painted on your house.”

Failure to comply, the letter says, “will leave the Town with no other choice than to pursue additional enforcement measures including, but not limited to, issuing civil citations.”

Bowden claims a road-widening project left his once-arboreal yard, at 305 SW Maynard Road, void of trees and with a steep slope that funnels rain water into his home.

Bowden’s complaints are not news to town leaders. Assistant Town Manager Mike Bajorek said the town offered a solution that was unsatisfactory to Bowden.

"We have gone to him and said we have a design that would help resolve (the drainage issue)," Bajorek said. "He said, 'No. Stay off my property. I want you to buy my house.'"

Bajorek said the town has purchased houses with drainage problems when there was no possible solution but that it is not willing, at this point, to spend tax money to buy the house.

"Here in Cary, we welcome our citizens to get involved to express their opinions, but we have community values and standards that we need to uphold," Bajorek said. "Making your home a billboard is not one of those standards.""

Drove by this today and can't believe there's still no resolve to this situation. It's been months. Just declare eminent domain and take his property without compensation.

NC passed some eminent domain laws in response to the Kelo v New London ruling. His property would have to be a blight to get it taken, and I don't think paint and shiz makes the cut.

Fun aside:

Since the Kelo decision, Pfizer (the company that teh city was trying to get to move in on the property), decided to close down the project and leave town. So all that stuff that the city bought from it's owners and sold to Pfizer looks worse now. There's an adandoned office building and some empty land.

Haha, I hope Cary wastes millions of dollars in taxpayer money fighting this.

Cary and the ACLU deserve each other.

Quote :
"The lawsuit asks the court to declare the town’s sign ordinance unconstitutional and to issue a temporary restraining order and an injunction against the Town.

“In order to save itself from embarrassment, the town is attempting to silence Mr. Bowden from engaging in core political speech directed at the very governmental authorities who are seeking to suppress that speech,” ACLU-NCLF Cooperating Attorney Mark Sigmon said in a release. “Enforcement of the Town’s sign ordinance under these circumstances is a clear violation of the First Amendment.”"

^I was thinking along the lines of a nice new paint job. Isn't the object of the vandal to piss off the owner of the thing that they are vandalizing? Wanna piss the guy off? Paint his house normal one night while he sleeps. Then hide in the bushes with a camera, film him coming out of the house in the morning, then post the video on youtube.

Plus it would be entertaining to see the new phrase he inevitably paints on his house. Guaranteed to be crazy++; by that point.

Great, that guy is just looking for a handout. It's slightly ironic that the conservative Fox News networks supports this.
