The difference is that with the Duke case, we don't KNOW that they're guilty or innocent (besides the fact that it's pretty clear that they're innocent).

With this case, we KNOW the kid was punched in the face. His jaw was broken and he had to have it wired shut for a while.

Just look at the evidence for the two cases. The evidence for the Duke case essentially says they didn't rape her, whereas with this, the guy's jaw was wired shut so it could heal back together.

Peyton allegedly used a club or some sort of blunt instrument to attack the guy and take his Playstation. This shows that even though he was a gun owner, he had enough civility to be aware that he did not want to kill his intended target, and therefore he was not as "dangerous" as the police made him out to be.

Determining that he was a threat through his facebook pictures was bullshit, as there was no reason to believe that he was just going to sit around his apartment with a loaded AR-15 within arms length. At the time of the assault, his guns were most likely where most people's guns are: hidden in the closet or locked away in a safe.

If anything, this is a great argument against a national gun registration database. Besides being only relevant to those who purchase their firearms legally, now every law enforcement agency knows what you have and can overreact accordingly.
