IIRC the shovel was just some random thing they saw when they went out looking for her. Not close to the crime scene or anything - like they were walking around the neighborhood and saw a shovel behind someone's house while the crime scene was still in an unknown location and miles away.

1) the CPD officer didn't document the hay
2) other officers had been at the site where the body was found and in the cooper house prior, so they could have tracked it in as well

a mistrial with prejudice means that retrying someone would violate double jeopardy and is typically seen in cases of judicial or prosecutorial misconduct
