^they do have a way to cut them off. on my silverado you have to push the dome override button 4 times in 5 seconds. you can also start the truck with the parking brake on

How could you prove that their lights were off if there are no other witnesses other than you and the other driver? They could simply just turn their lights on after the accident and claim they were on the whole time.

most if not all new cars have black boxes in them that determine speed, if the brakes are applied, et cetera. I do not know if that covers having the headlights on. I guess it is common sense though, you are more visible with your headlights on, it isn't a matter if you can see or not, it is being seen that counts.
