all engineers hate it but it is so important especially in a case like this. i think mr. ward would have documented his work if he knew ahead of time what he was investigating.

i don't think the defense did a good enough job differentiating between forensic analysis and network security. they tried to make a run at the very end to argue that analyzing the FBI's data would fall under his experience as a network security expert, but did not do a good job showing that from the beginning. i don't think its bias by the judge, the defense needed to do a better job showing why he was qualified instead of waiting for the last second to try to spell it out.

They still have the data I assume so I am sure they can find someone else that is an expert or whatever they want and get him/her to go back on that same info and document and trace every bit of that information.

then again Kurtz could word it where he doesnt seem to be an expert in forensics just in looking at security breached data.

That was the purpose here. The judge is just too stupid to understand the difference. Really--someone with 18 years of security analysis isn't qualified, but an FBI guy who can't figure out how to turn on a phone is??

Though I've disagreed with some of the judge's rulings thus far, the defense did a poor job with presenting this expert. It also doesn't help that he has next to zero forensic experience and has no documented procedures for what he did with the hard drive.
