What if Trayvon felt threatened first, but since he was unarmed decided to mete out deadly force with his fists? They were really both standing their ground, just in some wild wild west shit where you can legally kill the other guy if you get in a fight with him. 7/29/2013 11:09:26 AM |

Slightly off topic...
But I know quite a few people, myself included, that were 'less than perfect little angels' growing up....and then grew up to be contributing members of society. It's a shame that some of these kids lives are cut short because someone with a gun has a short temper or a misunderstanding. And its shameful to pretend that because a teenager is doing something stupid, they are automatically going to turn out to be some sort of criminal.
Just a thoughting

it's funny some people are so concerned about living in a police state or nanny state, but they seem fine living in a state where if someone is acting slightly out of what they perceive as the norm, it should be okay to murder them.

GZ is a bitch for pulling a gun during a fair fistfight. This was not some sort of vicious attack by Trayvon Martin, it was a fight GZ started by following some dude in the dark and hollering at him. Even if Trayvon threw the first punch GZ started it by chasing him and hollering at him. 7/29/2013 6:18:07 PM |

Except when it "just happens", had the parents been more involved and been more aware. It wouldn't have happened.
I never ran into a neighbors yard because:
1. I grew up in the sticks, where everyone has a gun and warning shots are a gift. 2. You don't go on other people's property. Its called respect.

I just don't get the Trayvon analogies. This happened right outside the 7th Ward in New Orleans. Not exactly a gated community in Florida. And if a 'professional thief' is on your property at 2am in New Orleans, its not quite the same as getting something out of your mom's car. It's too bad some dude shot him, but sometimes 'professional thieves' don't grow old and get to tell all the tales of how they robbed people and nearly got shot. Sometimes they get shot in the head. Of course this guy is still alive, so he might still get to reminisce on his thievery escapades.
There are just so many differences in this and the TM/GZ case, I don't get the comparisons. A kid was shot, thats about the only comparison. Every other element was very different. 7/30/2013 2:15:31 AM |

Got this email today
Quote : | "Last year, our son Trayvon Martin was stalked, chased down and killed by George Zimmerman, and Zimmerman received no punishment whatsoever. That's in large part because Florida is one of at least 21 states with some form of 'Stand Your Ground' law which enables people like George Zimmerman to claim self-defense. 'Stand Your Ground' was never meant to give aggressors the opportunity to get away with murder, but that is what happened when our son Trayvon was killed. After Trayvon's death, law enforcement used the law as an excuse to refuse to arrest George Zimmerman. Even worse, the jury in the case was instructed to think of what Zimmerman did as self-defense, even though Zimmerman ignored instructions from the police and instigated conflict with our son, who was just trying to get home to his father. We are shocked and heartbroken by the jury’s decision to allow our son’s killer to go free. Despite our despair, we must honor Trayvon’s legacy by doing all that we can to protect other young people from being targeted, pursued, and senselessly murdered. We started a petition on Change.org calling on 21 governors whose states have some form of 'Stand Your Ground' laws to review those laws and amend them so that people who instigate conflicts -- people like George Zimmerman -- won't be able to use these laws to get away with murder. We are not the only ones calling for 'Stand Your Ground' laws to be reviewed. President Obama spoke out on the need for review, and prominent Republicans like Senator John McCain have joined him. This is not a Democrat or Republican issue, it’s not ‘black’ or ‘white’ issue, it’s a wrong and right issue. This is a matter of making sure that no other family will ever have to go through what we have been through. No parents should ever have to know what it feels like to watch your child's killer walk free. Our hearts broke on the night of February 26, 2012 when George Zimmerman killed our son -- and we were stunned and devastated when the police refused to arrest Zimmerman. We petitioned for Zimmerman's arrest on Change.org, and after more than 2 million people joined our call, Zimmerman was charged with our son's murder. We felt so much closer to justice for Trayvon, and so grateful for the support of those who signed our petition. But on July 13, 2013, our hearts broke again when the jury set Zimmerman free. Our hearts broke because it is so hard to accept that we can't protect Trayvon anymore. But we can fight to make sure that this never happens again. Please sign our petition calling for a thorough review of all 'Stand Your Ground' laws to prevent killers like George Zimmerman from going free. We want to say thank you to all of you who have stood up for our son. Because of all your efforts, Trayvon’s life is celebrated all over the world. Please continue to stand with us as we fight to ensure that his legacy is to leave behind a safer and more peaceful world for all our sons and daughters. Thank you, Tracy Martin and Sybrina Fulton

Why do people keep saying this? Do you have any idea what you're talking about? Stand your ground isn't an affirmative defense that you just "use." I mean, technically you can, but you'd be an idiot for doing it. It's more effective if you just allow it to be the new stupid legal standard that takes away the duty to retreat. SYG was CLEARLY in the jury instructions, so the defense "used" the stupid law exactly how they should have.8/7/2013 2:47:33 PM |

http://www.cnn.com/2013/04/30/justice/florida-zimmerman-defense
it was tried as standard self-defense. zimmerman waived his right to stand your ground as a defense.
also, the instructions to the jury (which I have quoted below) are instructions based on self-defense law which has a stand your ground provision, but those instructions are the same for all Florida self-defense cases.
Quote : | "If George Zimmerman was not engaged in an unlawful activity and was attacked in any place where he had a right to be, he had no duty to retreat and had the right to stand his ground and meet force with force, including deadly force if he reasonably believed that it was necessary to do so to prevent death or great bodily harm to himself or another or to prevent the commission of a forcible felony." |

Waiving the right to something that would hurt their case, and leaving the standard in the jury instructions. Exactly. The only reason Florida allows a person to bring SYG as an affirmative defense is because of the same stupid legislature that enacted law in the first place. It was never supposed to work that way, it isn't effective as an affirmative defense, and that's why they didn't "use" it.

because SYG removes the obligation to retreat. Zimmerman couldn't retreat while he was on his back getting his head bashed into the concrete. Even if SYG didn't exist under the same circumstances with the evidence provided the jury would have be obligated to acquit.8/7/2013 4:58:23 PM |
