they cut the camera back on and Kurtz was talking about how Gessners "rulings had consistantly been outside of the realm of reasonable jurisprudence" or something like that, Judge denied the motion then Kurtz went into the defense's favorite memorialization line about "the defendant's 5th 6th whatever amendment rights"

the state can appeal the conviction, and the appeals court can order a new trial. but in order for that to happen there needs to be a massive, epic fuck up, like the chicks on the jury banged brad cooper. it's far easier for a person convicted to be awarded a new trial on appeal than it is for the state to win a new trial for someone found not guilty. right now the fuck ups favor the prosecution. theyd never get a new trial.
