So all the headlines today were talking about how Biden announced that Russians have committed war crimes.

Ok.

My question is this - how is the invasion itself not a war crime? Ukraine was minding its own business when all of a sudden big bully Russia is like "I want your lunch money and I'm going to take it." And then it does. Or tries to, thus killing lots of innocent civilians in the process.

But what if they hadn't killed a single civilian...what if they'd only killed members of another country's army? Is that cool? What are the rules here? You can invade another country as long as you don't kill civilians?

The invasion itself is a fucking war crime!

The short and simple answer is that the United States has invaded countries under similarly dubious pretexts and would like to continue having that option in the future. Prosecuting this invasion as a war crime would invite the same for U.S. political and military actors. Sure, nothing would really come of it, but it's one step too far into hypocrisy.

"Crimes against peace" was also one of the flimsier charges to come out of Nuremberg. It's one thing to say "You can't murder everyone." But effectively banning war is tantamount to castrating the state in matters of foreign policy. It's not really practical.

You've basically outlined it. Ukraine is already laying the groundwork for abandoning the pursuit of NATO membership. I don't see Putin conceding territory he's already taken and held for years, so some recognition of Donbas/Crimea is going to have to happen. Then Russia leaves and the West pours development money into Ukraine. That will be a mixed blessing unless Zelensky is willing and able to use his demigod status to smash corruption, but it's better than "now we're part of Russia."

But you'll notice that we hear a lot about Russian casualties and materiel losses, but almost nothing about Ukraine's. But what information we have suggests that the Ukrainian armed forces have also suffered heavy losses. This war can end in a Ukrainian strategic victory - at this point I think it's the most likely outcome - but it won't end with Ukraine dictating terms. Putin can't allow that because he wouldn't survive it.

The most recent estimate that Zelensky gave was on March 12, and said about 1,300 Ukrainian soldiers had been killed. That's two weeks ago and was undoubtedly a low-ball figure. More telling than the number is how little it's being talked about and how difficult it is to get any estimate out of anybody, which hints that the picture must not be very rosy - if Ukrainian losses were astonishingly light, they'd be more open about it, especially in comparison to the staggering Russian losses.
