Like is has been said before, nobody can really know exactly what happened in there but them. However, from the looks of it they were both being stupid and irresponsible.

The girl should have known that if she was going to go get drunk at a party that guys would try and get laid (as this guy's goal that night probably was). She put herself in a situation in which she was intoxicated in a place full of guys trying to get laid and that is her fault for not having more self-control.

He should have realized that she was drunk enough that she would do something she would not normally do sober and he was putting himself in the position that he could be accused of rape, though it seemed consentual at the time. He did not, however, rape her. She is just as much at fault as he is.

Him being drunk and having sex with a girl makes him no more responsible for it than the drunk girl. They both simply did something stupid and nobody should be accused of a crime here.

Yes, I believe he can do that. I remember one of my freshman introduction classes; the professor said that if two drunk people fuck in NC, she can accuse him of rape and he can accuse her of sexual assault.

And if this is just a case of "two kids got smashed and had sex", I think he should do it. It wouldn't be fair for him alone to go down, if that hypothetical is true.

If you have to get a girl drunk for her to have sex with you, then you're pathetic and you deserve what you get (not the sex, the rape charges). There's a big difference between having sex with a drunk girl who would have sex with you if she were sober and taking advantage of a drunk girl who wouldn't normally have sex with you, and when you're in that situation it's usually pretty obvious.

That said, we don't really know what happened so it's ridiculous for us to conjecture and lay blame. For all we know the girl could have been passed out.

Let it be a lesson though. If someone is drunk and you're at all unsure if they would normally hook up with you, then videotape the whole thing so you can prove that they gave consent. That's what I do.
