i understand this type of regulation. i'm saying how does it apply to paint on a house? is there a maximum amount of blue? pink? green? is there some law that says any lettering on a house is considered signage? if so what was the intent/purpose of that law when it was written and did it envision prohibiting actions like this? would he be considered for a variance or special exclusion?

seems to me they are trying to regulate taste and tact, not community standards

The original was some words painted directly on the house, the last image I saw ITT looked like a sign attached to the house:

But Cary's complaint was probably made when it was nothing more than paint applied directly to the house.

For those of you incapable of reading posts on the previous page, he hasn't been living in his house for several weeks at least. It's doubtful he will ever be able to live there again.

You can't fight city hall. But you can killdozer the entire town on a suicide mission, especially if you have a terminal illness.

Quote :
"CARY, N.C. — A Cary man who battled the town over a message displayed on his home has died, his daughter told WRAL News Friday.

David Bowden, 69, died at Rex Hospital in Raleigh Wednesday, his daughter Dawn Brown said. He had lung cancer and had also contracted a bacterial infection.

Bowden spray painted the phrase "Screwed by the Town of Cary" on his house at 305 SW Maynard Road in August 2009.

He claimed a widening project left his once-arboreal yard void of trees and with a steep slope that funnels rain water into his home. He said he was frustrated by unsuccessful negotiations with Cary officials, including a request from him for the town to buy the house.

The town of Cary tried to fine him for violating town ordinances that specify how and where signs can be displayed, but the American Civil Liberties Union sued on his behalf, saying the message was political speech.

U.S. District Judge Louise Flanagan ruled in December that the town violated Bowden's freedom of speech and ordered it to pay $46,197.27 in attorney's fees and court costs. The town had appealed the ruling.

Bowden revised the message in February, inviting passers-by to tour "some of Cary's finest engineering and construction." It continues, "Oh by the way, now I have lung cancer but remember I put up a good fight."

Bowden is survived by his daughter, her husband, his granddaughter, and his brother and sister-in-law.

A service to celebrate his life will be held at Fellowship Baptist Church Ministry Center, 1701 Bud Lipscomb Road in Willow Spring, from 11 a.m. to 2 p.m. Saturday."

What does this mean in terms of his lawsuit against Cary? Do they still have to pay his lawyers and give his family $1 if they lose the appeal? Or is it all through the ACLU and it doesn't matter that he's dead now?

Tdub lawyers, you're my only hope!

His daughter has no desire to continue his fight in any way. She just wants to sell the house for what she can get for it, and move on. I even offered to take over for her but she just doesn't care. In some ways it sucks, cause it just means his entire fight was for nothing, but I can see if from her standpoint, she just wants it to all be over and done with.

Yeah if I were in her shoes I'd want absolutely nothing to do with it. Did Cary put a lien on the property? If so, wouldn't it then become the new owner's responsibility?

Cary should just buy it, tear it down, and make it greenspace

well whats sad is that the sign lawsuit was a win-win situation for Cary since it was never established that they should owe him for any negligent engineering/construction of the widening project aka the root of all the problems. he lost sight of the prize (his property value). now its being sold as is without warranty (since they would have to cover the known defects under a warranty otherwise or at least disclose it to a risk-taking buyer that doesn't exist).

She'd be a damn fool not to disclose the known issues on that house in the disclosure paperwork. Considering the amount of press that address has gotten that's just a lawsuit waiting to happen if she didn't disclose it to the property buyers, who somehow didn't know the press surrounding this house, then found it out later on.

Housing market is already terrible, nobody's going to buy this house unless they get it extremely cheap. Issues will probably be halfass fixed and it'll end up being a rental for some mexicans or something.

^^ it's not that she doesn't have to point out the defects it's that she doesn't have to COVER the defects if something does go wrong and flood again

She doesn't really even have to point out any defects, she can actually just say something like "I make no comment as to the condition of the yard drainage." I mean, that's basically saying you know something's up, but it's not putting it right out there, especially if the house is sold as-is.

They need to bulldoze the house and build some viewing decks. Then market it as "The Niagara Falls of the south"

Apparently the daughter was "distraught" to take the sign down until the neighbors paid her to

^^ true, but on the NC disclosure form you have to check yes, no, or no representation. I guess she could check the third option but that would be dishonest imo.

It's weird how you put distraught in quotes, when it doesn't mention anything at all about her state of mind in the article. Then again, her father just died, do you think that's an inappropriate response?

And would you have spent money out of your own pocket to remove the sign? I mean, if someone else is gonna pay for it, why the fuck wouldn't you let them?

indeed.

Did you even read the article?
Quote :
"Thomas Flynn, the broker handling the house, said Brown refused to take the sign down before they listed the property. Brown said Bowden had told her that he wanted the sign to remain.
Flynn said Brown changed her mind after Michelle Muir, a mayoral candidate, offered to help remove the sign.
"She approached us and said she'd taken donations, and that they were willing to take the sign down to help it sell," Flynn said. "I approached the seller with this idea. She was a little distraught about it, but she decided to go ahead and do it. She thought it might be the right thing to get the house sold."

They bought some new wheels for it, and I think they're just gonna keep it in storage. I know it was in his will to use it to drive his ashes up to the mountains in, but aside from that, I don't think they have any particular plans for it.

People inherit shitty houses all the time. I have toured a large number of the estate sale homes currently in the market in the Raleigh area. I have learned that there are two types of people selling estate properties.

Type 1: Want to dump the house while putting zero effort into rehabbing the home. Homes are usually in disrepair and/or look like the Brady Bunch barfed all over the interior. Few people are willing to buy houses in those conditions so they sit on the market for some time.

Type 2: Gut the interior or significantly rehab the home. Houses tend to sell for more than they would have if in type 1 condition and definitely sell faster.

So yeah, it sucks she inherited a shitty house, but she's not in an abnormal situation. I bet everyone else who's ever inherited a home that looks like crap wish they could get their neighbors to help pay for some of the repairs.
