No, it means the DA's office determines whether or not to push for a retrial. He'll likely be tried again, bond won't decrease, and he'll sit in jail until they do it all again.
Or both sides realize that a trial will get them nowhere and they work on a plea deal.
Judge may be declaring a mistrial now: asking for input from the jury.

Most defendants in big cases like this do. Young actually has a public defender and a paid attorney. BC had two public defenders (one was paid until the money ran out).
By paid attorney, I mean privately retained. The public defenders obviously still get paid.

They may move him to the prison for the duration. They may release him on bond. It just depends on what the parties want to do. They may get it scheduled soon (but the calendar is usually pretty full). And of course, they may just work out a plea deal to avoid all of this again. I imagine the plea is easier to get if it's 8-4 Not Guilty, versus 8-4 Guilty. 6/27/2011 4:08:46 PM

I think you've got it the wrong order. 8-4 guilty the plea would be easier. The state didnt convince 4 people, take the plea in case you can't convince any next time around, plus its costly to do another trial. The defense now knows your presentation. But, under that same situation the defense sees 8 people it can't convince, plea out.
If the 8 leans toward not guilty, state would push for a plea to save face but the defense won't take that crap. This will go to trial, unless the state gives up

^Nah, defendant has time served under his belt. If he gets a plea deal for 8 years, he's only got 5ish left, 4 once you get to the point of retrial. He'd jump at the opportunity. Prosecution wants to get this away from the Cooper trial stigma.

i think Klinkosum was actually his PD.
he works for Cheshire now, but at the time the case was assigned, Klinkosum was still in the PD's office. he didn't go to Cheshire's office until 2009 or 10, i think. 6/27/2011 4:46:36 PM

i wonder if it had came back at 9-3 or 8-4 originally, if Stephens would've broke out the Allen Charge.
at 6-6, he really couldn't do that.
this has been a crazy case; i thought with all the circumstantial evidence the DA's had from the beginning, they would win this one easily, but, the defense had one of the better closings i have ever seen from anyone. 6/27/2011 4:51:38 PM

Collins has been the head of the PD's office since its inception and Klink worked there at the time.
Young retained Wade Smith initially, but ran out of money well before trial. At that point, they removed themselves, and the PD's office took over.
Sometime in the midst of all that, Klink went to Cheshire's office, but stayed on for the trial (I think that was the sequence of events) 6/27/2011 4:53:52 PM

Okay, thanks. I knew Wade Smith was around at first (and hence Alice Stubbs), but I couldn't recall the chain of events that lead to these two.
I agree, their closings were really wonderful. I think that, coupled with Young taking the stand sealed the deal for the not-guilty votes. I thought it was a slam dunk case, but I will NEVER be surprised by a jury. 6/27/2011 4:55:33 PM

now everyone is starting to see why these prosecutors offer insane plea deals to everyone. i used to think it was because they were bad - but it seems like they're always left holding the bag full of no evidence because the cops don't know how to cop.
I actually wasn't leaning either way before this trial started, and after hearing all the negative stuff about Jason Young, I was expecting a slam dunk case. The media made him look like the devil, and it took them years to arrest him. I was sure the trial was gonna smoke him.
but holy shit was I wrong.... a couple ex-girlfriends, a pissed off mother-in-law, and a hillbilly pump jockey who swore she saw him. OMG MURDERER. Then he gets on the stand and they shit themselves, like he busted out a trick play. ahhahahaha.
So glad to see him at least get another shot at trial.

Now, the office is down to 25 legal assistants and 41 assistant district attorneys who are funded by state funds to handle the approximately 220,000 criminal cases filed in Wake County every year. About 15,000 of those are felonies.
"Oftentimes, we have to bring files up here to (the front desk) to prepare for trial," Assistant District Attorney Becky Holt said. "Tomorrow, I have to go to court and try a case, so it's just a matter of juggling. But there's not a whole lot of options. The phones have got to be answered, and we have to be open for business."
District attorney offices statewide are experiencing similar employee losses.
According to the North Carolina Conference of District Attorneys, 55 legal assistant positions have been cut across the state, and another 15 weren't filled after employees retired.
Five assistant district attorney jobs weren't filled after people retired, and another three positions are frozen for two years.
Although the budget cuts are hurting many district attorney offices, lawmakers who support the new budget say the cuts had to come from somewhere.
But Gov. Bev Perdue says the cuts are too severe.
"North Carolina needs to find more resources to prop up the court system," she said Tuesday. "The DA's staff is obviously a consequence of a really hard budget that didn't need to happen."
Willoughby says he fears that the current budget crisis could worsen.
"I'm concerned that, given both the budget that got passed this year and what it appears to be the future, it's not going to get any better," he said. "We may have additional cuts in the future. If so, we'll have to cut back the services, and we're struggling to try to avoid that."" |
